Approving the preliminary plat of
The Forest at Eastwood Estates on an approximately 8.26 acre tract of land
generally located on both sides of Wallace Avenue, north of E. 49th Street.

BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of The Forest at Eastwood Estates on an approximately
8.26 acre tract of land generally located on both sides of Wallace Avenue,
north of E. 49th Street, and more specifically described as follows:
All that part of the
Northwest Quarter of the Southeast Quarter of Section 30, Township 49, Range
32, in Kansas City, Jackson County, Missouri, described as follows: Beginning
at the Northeast Corner of Lot 17, EASTWOOD ESTATES, a subdivision in said
City, County, and State; Thence South 864809 East, along the North line of
said EASTWOOD ESTATES, a distance of 569.81 feet to the Northeast Corner of
said EASTWOOD ESTATES, said point being on the East line of said Quarter Quarter
Section; Thence North 020351 East, along said East line, a distance of
626.92 feet to the point at which it intersects the South line of WALNUT ACRES,
LOTS 10 THRU 27, BOTH INCLUSIVE, a subdivision in said City, County, and State,
or its prolongation; Thence North 864621 West, along said South line, a
distance of 577.67 feet to the Southeast Corner of Lot 26, WALNUT ACRES, LOTS
10 THRU 27, BOTH INCLUSIVE; Thence South 012050 West, a distance of 627.43
feet to the Point of Beginning. Containing 8.26 Acres, more or less.
is hereby approved, subject to
the following conditions:
1.
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2.
That the developer submit a macro/micro storm drainage study to the
City Engineer's Office for approval for the entire development when the first
plat is submitted, and that the developer construct any improvements as
required by the City Engineer's Office.
3.
That the developer submit plans for grading and siltation and erosion
control to the City Engineers Office for approval prior to the commencement of
any construction activities.
4. That
the developer obtain a land disturbance permit from the Public Works Department
prior to beginning any construction, grading, clearing or grubbing activities,
if the disturbed area exceeds one acre.
5.
That the developer contribute $7,381.99 in lieu of parkland dedication
for 26 units (26 units 3.7 .006 $12,789.30 (year 2004) = $7,381.99) in
satisfaction of Section 66-128 of the Subdivision Regulations.
6.
That the developer install hard surface roads and provide for fire
protection as required by the Fire Department prior to construction beyond
foundations.
7. That
the developer construct temporary off-site cul-de-sacs at the east end of 48th
Street as required by the Department of Public Works.
8.
That the developer extend water mains as required by the Water Services
Department.
9. That
the developer extend sanitary sewers to ensure individual service is provided
to all proposed lots and determine adequacy as required by the Department of
Public Works.
10. That
the developer provide a storm water conveyance system to serve all proposed
lots within the development and determine adequacy as required by the
Department of Public Works.
11. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval for the maintenance of private open space and enter
into a covenant agreement for the maintenance of any stormwater detention area
tracts.
12.
That the developer submit a street name signage plan for the entire
development area for approval by the Street Naming Committee prior to submittal
of the first final plat.
13.
That the developer submit a street tree planting plan as part of the
final plat, secure the approval of the City Forester for street trees planted
on right-of-way in front of residential lots (with a copy to be submitted to
the City Development Department), and agree to plant in conformance with the
plan approved by the City Forester. The plan shall include size, type,
species, and placement of trees.
14.
That the developer design and construct all interior streets to City
standards as required by the Department of Public Works, including curb,
gutter, storm sewers, streetlights, and sidewalks.
15.
That the developer obtain the grading consents, and all grading,
temporary construction and drainage/sewer easements from the abutting property
owner prior to submitting any public improvements.
A copy of the preliminary plat is
on file in the office of the City Clerk under Document No. ______, which is
attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices have been given and hearings
have been held, required by the Subdivision Regulations.
