COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120102

 

Authorizing the Director of Public Works to execute a property sales agreement with the Missouri Highway and Transportation Commission providing for the conveyance of certain state-owned real estate to the City.

 

WHEREAS, the Commission is the owner of certain real property, together with all improvements thereon, and ownership interest in the ingress/egress access to said property located at 87th Street, in the City of Kansas City, County of Jackson, State of Missouri, consisting of approximately ten (10) acres; and

 

WHEREAS, the City is the owner of real property together with all improvements thereon, located at 87th Street, in the City of Kansas City, County of Jackson, State of Missouri, consisting of approximately twelve (12) acres which adjoins the Commission property; and

 

WHEREAS, the City has approved and supports a project known as “Oxford on the Blue,” proposed by Oxford Redevelopment Company consisting of the redevelopment of more than three hundred twenty five (325) acres of land within Kansas City, through the construction and operation of an Urban Biosciences & Technology Park, expected to generate significant economic development and subsequently benefit the Greater Kansas City community; and

 

WHEREAS, the parcel of land that encompasses both the Commission property and the City property is located in the center of the proposed “Oxford on the Blue” development and its inclusion in the redevelopment plan is integral to the success of the Oxford on the Blue project; and

 

WHEREAS, in furtherance of the Oxford on the Blue project, the City seeks to acquire from the Commission, and the Commission is willing to vacate and convey the Commission Property to the City on certain terms and conditions as outlined in a certain Property Sales Agreement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public works is hereby authorized to execute a Property Sales Agreement with the Commission and to accept title to the Commission property, all as described in said agreement which is approved in substantial form to that which is on file in the office of the Director of Public Works.

 

Section 2. That the Director of Public Works is authorized to expend a sum not to exceed $600,000.00 from funds previously appropriated to the following accounts:

 

3090-898501-89008199 Roadway NC5 $300,000.00

3090-898601-89008199 Roadway NC6 300,000.00

TOTAL $600,000.00

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
