RESOLUTION NO. 150833

 

Amending the Proposed Land Use Plan within the Westport Planning Area Plan by changing the recommended land use on a 4.6 acre tract of land, generally located south of E. 38th Street, west of Gillham Road, north of E. 39th Street and east of Warwick Boulevard from Public and Semi Public land use to commercial. (132-S-43)

 

WHEREAS, on August 11, 1972, the City Council through the adoption of Resolution No. 41438 adopted the Westport Planning Area Plan as a plan for future development within an area generally bounded on the north by 31st Street, on the west by State Line Road, on the south by Ward Parkway and on the east by Troost Avenue; and

WHEREAS, due to certain changes, it is desirable to modify certain components of the Westport Planning Area Plan by an amendment to the Proposed Land Use Plan as it affects a 4.6 acre tract of land, generally located south of E. 38th Street, west of Gillham Road, north of E. 39th Street and east of Warwick Boulevard from public and semi public land use to commercial; and

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on May 4, 2015, as required by law; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan on July 21, 2015; and

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on July 21, 2015, recommend approval of the proposed amendment to the Westport Planning Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Proposed Land Use Plan within the Westport Planning Area Plan is hereby amended for a 4.6 acre tract of land generally located south of E. 38th Street, west of Gillham Road, north of E. 39th Street and east of Warwick Boulevard from public and semi public land use to commercial.

 

Section B. That the Council finds and declares that before taking any action on the proposed area plan amendment hereinabove, all public notices have been given and hearings have been held as required by law.
