ORDINANCE NO. 960068

 

Approving an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 10.0 acre tract of land generally located on the south side of N.W. Barry Road at approximately N. Adrian Avenue. (10051-CP-8)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 10.0 acre tract of land generally located on the south side of N.W. Barry Road at approximately N. Adrian Avenue, and more specifically described as follows:

 

A tract of land in the northwest corner of the East Half of the Southeast Quarter of Section 8, Township 51, Range 33, in Kansas City, Platte County, Missouri, described as follows: Beginning at the northwest corner of the East Half of the Southeast Quarter of said Section 8; thence east 660.0 feet; thence south 1649.98 feet; thence west 660.0 feet; thence North 1650.0 feet to the point of beginning, except that part conveyed to Green Hills Partnership by Warranty Deed filed September 20, 1978, recorded in Book 545, page 759, and described as follows: A tract of land in the Southeast Quarter of Section 8, Township 51, Range 33, Kansas City, Platte County, Missouri, being more accurately described as follows: Commencing at the northwest corner of the Southeast Quarter of said Section 8; thence South 0 25'48" West along the west line of the Southeast Quarter of said Section 8, 660.0 feet; thence South 88 40'12" East 1289.30 feet to the true point of beginning of the tract to be herein described, said point being also the northeast corner of Lot 2, Line Hills, a subdivision of land in Kansas City, Platte County, Missouri, according to the recorded plat thereof; thence continuing South 88 40'12" East 660.0 feet; thence South 0 32'13" West 990.0 feet; thence North 88 40'12" West 660.0 feet to a point on the east line of Lot 2, Line Hills #2, a subdivision of land in Kansas City, Platte County, Missouri, according to the recorded plat thereof; thence North 0 32'13" East along the east line of said Line Hills #2, 990.0 feet to the true point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer construct a 150 foot westbound left turn lane on N.W. Barry Road as required by the Department of Public Works.

 

5. That the developer indicate the 100 year floodplain boundary and base flood elevations on the final plat.

 

6. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer extend sanitary sewers as required by the City Engineer's Office.

 

9. That the developer provide for fire protection as required by the Fire Department.

 

10. That the developer submit a final plan to the City Plan Commission for approval including: site plan; dimension plan; grading plan; landscape plan; and signage plan

(including elevations). The landscape plan shall specifically show at least 8 white

pine trees along the west and south property lines (16 total) to screen residential uses

year-round, trees and shrubs within the island in front of the building and foundation

plantings.

 

11. That the landscaping as approved by a previous final plan, approved by the City Plan Commission on May 2, 1989, be installed and planted prior to the approval of a final

plan for this amendment.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 960068, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
