ORDINANCE NO. 140886

 

Rezoning approximately 2.17 acres generally located at the southwest corner of N.E. 102nd Terrace and N. Oak Trafficway from District R-80 to District B1-1. (13393-P-2, known as New Mark Crossing)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0979, rezoning an area of approximately 2.17 acres generally located at the southwest corner of N.E. 102nd Terrace and N. Oak Trafficway from District R-80 (Residential, 80,000 sq. ft. per unit required) to District B1-1 (Neighborhood Business 1, dash 1) said section to read as follows:

 

Section 88-20A0979. That an area legally described as:

 

A tract of land in the Northwest Quarter of Section 35, Township 52 North, Range 33 West, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Northeast corner of said Northwest Quarter; thence South 00 degrees 19 minutes 17 seconds West, along the East line of said Northwest Quarter, 982.49 feet to the Northeast corner of the South One-Half of the South One-Half of the Northeast Quarter of said Northwest Quarter; thence North 89 degrees 27 minutes 02 seconds West, along the North line of the South One-Half of the South One-Half of the Northeast Quarter of said Northwest Quarter, 62.61 feet to a point of the Westerly Right-of-Way line of North Oak Trafficway, as established in the Report of Commissioners Case No. CV104-005978CC as Tract No. 106, and recorded December 8, 2004, as Document No. T08788, in Book 4847 at Page 81; said point being the Point of Beginning of the tract of land to be herein described: thence Southeasterly along said Westerly right of way line along a curve to the right having an initial tangent bearing of South 76 degrees 19 minutes 41 seconds East with a radius of 16.40, a central angle of 76 degrees 38 minutes 58 seconds and an arc distance of 21.94 feet; thence South 00°19’17” West along said Westerly right of way line 311.62 feet to the Northeast corner of Lot 5, Romey Hills First Plat, a subdivision of land in said Kansas City, recorded August 7, 1978 as Document No. D-74118 in Book 1321 at Page 271; thence North 89 degrees 28 minutes 47 seconds West, along the North line of said Romey Hills First Plat, 482.80 feet; thence North 03 degrees 13 minutes 59 seconds West, 17.81 feet; thence North 75 degrees 31 minutes 19 seconds East, 153.03 feet; thence North 57 degrees 50 minutes 50 seconds East, 152.34 feet; thence North 42 degrees 00 minutes 53 seconds West, 127.52 feet; thence Northeasterly along a curve to the left having an initial tangent bearing of North 47 degrees 59 minutes 07 seconds East with a radius of 325.00 feet, a central angle of 14 degrees 59 minutes 36 seconds and an arc distance of 85.05 feet; thence North 32 degrees 59 minutes 31 seconds East, 34.44 feet to the North line of said South One-Half of the South One-Half of the Northeast Quarter of said Northwest Quarter; thence South 89 degrees 27 minutes 02 seconds East, along last said line, 207.41 feet to the Point of Beginning. Containing 94,425 square feet or 2.168 acres, more or less.

 

is hereby rezoned from District R-80 to District B1-1, all as shown outlined on a map marked Section 88-20A0979, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
