ORDINANCE NO. 150778

 

Approving and authorizing the Board of Parks and Recreation Commissioners to accept from the Land Bank of Kansas City, Missouri, the transfer of a parcel of land located within Swope Park which was inadvertently conveyed to the Land Bank.

 

WHEREAS, it is the desire of the Board of Parks and Recreation Commissioners to rectify the title on this parcel of land that was reverted to the Land Trust and then transferred to the Land Bank on April 13, 2013; and

 

WHEREAS, this parcel is a portion of the 18.62 acre parcel of land located within the Soccer Village at Swope Park and was considered part of Swope Park since Jackson County and the Chiefs transferred the land to the City; and

 

WHEREAS, the parcel which is currently held by the Land Bank, lies between the railroad and the Blue River and was the subject of an acceptance Ordinance No. 25395 by the City in 1960 and it is not clear why the County did not recognize this Ordinance, and why the property reverted to the Land Trust and was ultimately transferred to the Land Bank; and

 

  WHEREAS, the transfer of the deed from the Land Bank to the City would bring title back to the City, where it belongs; and

 

WHEREAS, the Parks and Recreation Department has communicated with the City Manager that based on preliminary authority from the Board of Parks and Recreation Commissioners, that it would like to correct the title to the property described below, and complete the re-acquisition process of this one parcel that is already part of the Soccer Village at Swope Park; and

 

WHEREAS, City Charter Section 1003 and City Code of Ordinance Section No. 53-1 require that the City Council approve and authorize the Board of Parks and Recreation Commissioners to acquire additional parkland; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City acknowledges receipt of a communication from the Director of the Parks and Recreation Department to the City Manager requesting the re-acquisition of that Swope Park parcel legally described as follows:

 

All that land lying in the southwest quarter (SW 1/4) of the northeast quarter (NE 1/4) of Section 2, Township 48, Range 33, described as follows: All that part of the west half (W 1/2) of the northeast quarter (NE 1/4), lying west of the center line of the Big Blue River, east of east line of right of way of Missouri Pacific Railroad, and south of a line drawn 1452.42 feet north of and parallel to south line of said northeast quarter (NE 1/4), except that party lying north of 63rd St Trafficway, and except 63rd Street Trafficway.

 

collectively referred to as the (“1960 Swope Parcel”) from the Land Bank of Kansas City, Missouri (“Land Bank”), by the City for park purposes.

 

Section 2. That the City approves and authorizes the Board of Parks and Recreation Commissioners to accept the transfer of ownership to the City without consideration for the addition of the 1960 Swope Parcel to Swope Park, which transfer will be made by Special Warranty Deed executed by the Land Bank and held in escrow until the subsequent passage of a resolution by the Board of Parks and Recreation Commissioners accepting the 1960 Swope Parcel for parkland forever.

 

Section 3. That the City authorizes the Office of the City Attorney to hold the Special Warranty Deed executed on behalf of the Land Bank, until such time that the City Attorney receives a certified copy of the resolution by the Board of Parks and Recreation Commissioners accepting the 1960 Swope Parcel for public use for parkland forever, which resolution along with a certified copy of this City Council ordinance will be attached to and become an exhibit to and a part of such Special Warranty Deed as recorded.
