RESOLUTION NO. 970238

 

Determining compliance of a portion of Phase II of the Old Town Redevelopment Project located at 6 West 3rd Street and authorizing the Director of the Department of City Development to issue a Certificate of Full Compliance for a portion of Phase II located at 6 West 3rd Street to the Old Town Redevelopment Corporation.

 

WHEREAS, the City Council did on September 13, 1984, pass Ordinance No. 56936, approving the application and the development plan submitted by the Old Town Redevelopment Corporation; and

 

WHEREAS, the Redevelopment Project was amended by Ordinance No. 64067, passed May 18, 1989, and further amended by Ordinance No. 961242, passed November 14, 1996; and

 

WHEREAS, Phase II of the Redevelopment Project proposed the rehabilitation of mixed use commercial/office/residential and parking; and

 

WHEREAS, the Old Town Redevelopment Corporation has requested a Certificate of Full Compliance for a portion of Phase II at 6 West 3rd Street; and

 

WHEREAS, Herbert E. Duncan, a registered architect, has identified that the portion of the project at 6 West 3rd Street as built consists of the rehabilitation of the building with four floors of residential apartments (49 apartment units with 40,000 LSF) and thirty parking spaces; and

 

WHEREAS, on January 7, 1997, the City Plan Commission reviewed the Development Plan and determined that the construction proposed in the Development Plan for the portion of Phase II at 6 West 3rd Street of Old Town Redevelopment Project has occurred and has recommended that the City Council authorize the issuance of a Certificate of Full Compliance to Old Town Redevelopment Corporation; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Council finds and determines that the portion of Phase II of the Old Town Redevelopment Project at 6 West 3rd Street has been completed and the construction is in compliance with the Development Plan.

 

Section B. That the Council hereby authorizes the Director of the Department of City Development to issue a Certificate of Full Compliance to Old Town Redevelopment Corporation pursuant to the terms and conditions of the Development Plan and Redevelopment Contract and pursuant to Section 74-17(d), Code of Ordinances of the City of Kansas City, Missouri, for the portion of Phase II located at 6 West 3rd Street, more specifically described as follows:

 

Lots 87 and 88, and all of Lot 89, lying south of the following described line: Beginning at a point on the east line of said Lot 89, 41.69 feet north of the southeast corner thereof; thence west to a point on the west line of said lot, 41.23 feet north of the southwest corner thereof, Block 9, The Town of Kansas, commonly called Old Town, a subdivision in Kansas City, Jackson County, Missouri.
