ORDINANCE NO. 080676

Approving the request for removal of real property from the Shoal Creek Valley Community Improvement District generally located on the south side of Missouri 152 Highway between Shoal Creek Parkway on the west and N.E. Flintlock Road on the east in Kansas City, Clay County, Missouri.

WHEREAS, the Shoal Creek Valley Community Improvement District (the District) was created on March 6, 2008, with the passage of Second Committee Substitute for Ordinance No. 080193; and

WHEREAS, Sections 67.1401 through 67.1571, RSMo, otherwise known as the Community Improvement District Act, allows for the removal of real property from the District upon request of a property owner and the satisfaction of statutorily required conditions; and

WHEREAS, the owners of the real property to be removed have requested said removal; and

WHEREAS, the Districts board has consented to said removal and certified that the District will be able to meet its obligations without revenue generated by the real property to be removed; and

WHEREAS, the petition requesting the removal is in proper form and all required conditions have been satisfied; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the request for removal of real property from the Shoal Creek Valley Community Improvement District as a separate political subdivision in accordance with Sections 67.1401 through 67.1571, RSMo, is hereby approved in its entirety.
