ORDINANCE NO. 060805

 

Approving the petition to establish the River Market Community Improvement District Inc.; approving the Citys inclusion within the signatories of the petition; establishing the River Market Community Improvement District Inc., generally bounded by the south bank of the Missouri River on the north, I-70-35 on the south, Burlington Northern Santa Fe Railroad on the west and Missouri 9 Highway on the east in Kansas City, Jackson County, Missouri; and directing the City Clerk to report the creation of the District to the Missouri Department of Economic Development.

 

WHEREAS, the property within the proposed River Market Community Improvement District includes several parcels owned by the City; and

 

WHEREAS, it is the Citys choice to support the establishment of the River Market Community Improvement District Inc., by being a signatory of the petition; and

 

WHEREAS, through this ordinance the City evidences its inclusion with those owners of property located within the proposed community improvement district (CID) executing petitions seeking establishment of a CID; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Petition to establish the River Market Community Improvement District Inc. (the District) as a not-for-profit corporation in accordance with Section 67.1401 through Section 67.1571, RSMo, otherwise known as the Missouri Community Improvement District Act (the Act), and which is attached to this ordinance as Exhibit 1, is hereby approved in its entirety; provided, however, the Petition and this Ordinance shall expressly exclude from the River Market Community Improvement District, any and all property within the River Market Community Improvement District owned by the Kansas City Terminal Railway Company, the BNSF Railway Company, The Kansas City Southern Railway Company and the Union Pacific Railway Company or their respective affiliates or subsidiaries, while such property or properties is or are owned by such companies or their respective affiliates or subsidiaries and until such property or properties are in the ownership of unaffiliated third-parties.

 

Section 2. That the Petition to establish the CID shall be deemed executed by the City as a property owner.

 

Section 3. That the District is hereby established for the purposes set forth in the Petition, that the District shall have all the powers and authority authorized by the petition, the Act, and by law, and shall continue to exist and function in perpetuity following the effective date of this ordinance.

 


Section 4. That upon the effective date of this Ordinance, the City Clerk is hereby directed to report the creation of the District to the Missouri Department of Economic Development pursuant to Section 67.1421.6 RSMo, by sending copy of this ordinance to it.
