RESOLUTION NO. 950705

 

Amending the policy of the Council respecting expenditures for aesthetic adornment of buildings and public property to respond to fiscal restraints imposed on the City and to recognize the talents of local artists.

 

WHEREAS, Resolution No. 37682, adopted March 13, 1970, declared it to be the policy of the Council that an amount equal to one percent of the engineer's estimate of the cost of constructing or remodeling any municipal building be devoted to features of aesthetic ornamentation and adornment of such building, unless, in any specific instance, waived by action of the Municipal Art Commission or dispensed with by action of the Council; and

 

WHEREAS, Resolution No. 52393, adopted January 23, 1981, restated and amended the policy by providing that, in the event such features are waived or dispensed with, the amount that would have been allocated to pay the cost thereof in accordance with the one percent provision shall be available to be used, together with any other available funds, for the aesthetic ornamentation and adornment of any municipal building or other public property; and

 

WHEREAS, on December 11, 1986, the Council passed Ordinance No. 60321 establishing Public Art Fund No. 635 to receive contributions, allocations and appropriations for the acquisition and installation of works of art and other aesthetic adornments to public buildings and property in accordance with Resolution No. 52393; and

 

WHEREAS, the Council reaffirmed its commitment to the policy set forth in Resolution No. 52393 and implemented by Ordinance No. 60321 when it adopted Resolution No. 65539 on May 17, 1970; and

 

WHEREAS, it is the desire of the Council to recognize the talents of established artists and art students in Kansas City and elsewhere in Missouri by giving them first consideration in the award of contracts for public art in the One Percent for Art Program; and

 

WHEREAS, in recognition of the fiscal restraints placed on the City in providing necessary public improvements, the Council finds it necessary to amend its public art policy in the implementation of the One Percent for Art Program; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

That the policy of the Council with respect to the One Percent for Art Program reaffirmed in Resolution No. 65539 is hereby amended and modified, subject to bond document provisions, as follows:

 

The funds designated for the One Percent for Art Program for any capital improvements project for which the total final cost of the project exceeds the engineer's original estimate may be allocated by the Council first for the payment of such excess cost, and any remaining balance for the art program.

 

Funds appropriated under the One Percent for Art Program pursuant to recommendations of the Municipal Art Commission shall be available for re-allocation by the Council to pay the cost of any capital improvements project.

 

Missouri artists and students studying art in Missouri schools or institutions shall be given priority consideration for the award of contracts under the One Percent for Art Program.

 

BE IT FURTHER RESOLVED, that this Resolution be spread upon the Minutes of the Council in testimony thereof, and that the City Manager be hereby directed to bring the policy of the Council set forth herein to the attention of all heads of department with appropriate instructions as to the implementation thereof.
