ORDINANCE NO. 140272

Authorizing the Director of City Development to cast one or more ballots on behalf of the City consenting to a sales tax within the 4840 Community Improvement District.

WHEREAS, the 4840 Community Improvement District (the “4840 CID”) was established as a political subdivision by Ordinance No. 130205; and

WHEREAS, the 4840 CID seeks to impose a sales tax on all retail sales made within its boundaries to the extent such sales are taxable pursuant to state law; and

WHEREAS, Section 67.1545, RSMo, requires that the question of imposing such a tax be submitted to the qualified voters of the district; and

WHEREAS, no registered voters reside within the boundaries of the 4840 CID and the City is the sole owner of the parcels of real property located within the 4840 CID; and

WHEREAS, Section 67.1401.2(14), RSMo, provides that the City shall, in the absence of registered voters, be deemed the qualified voter for purposes of authorizing the imposition of the sales tax; NOW, THEREFORE,

 BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 Section 1. That the Director of City Development is authorized to cast such ballots as may be required, on behalf of the City, consenting to a sales tax within the 4840 Community Improvement District.
