ORDINANCE NO. 070036
Authorizing the Director of Water
Services to execute an Agreement with the Universal Land Development Co., L.P.
and the Tax Increment Financing Commission of Kansas City, Missouri for
financing, design and construction of stormwater controls in the Executive Park
area; appropriating funds and authorizing the Director of Water Services to
expend up to $850,000.00 for the project; directing the City Clerk to record
this ordinance and agreement; and recognizing an emergency.
WHEREAS, the
City Council passed Ordinance No. 061263 on November 30, 2006 to approve an amendment to a previously approved development plan in District URD on
approximately a 217.62 acre tract of land generally bounded by Front Street on
the south, Universal and Reynolds Avenues on the west, the Missouri River on
the north and I-435 on the east; and
WHEREAS, as a
condition of Ordinance No. 061263, Universal Land Development Co., L.P. is
required to enter into an Agreement for Stormwater Control Improvements with
the Water Services Department and the Tax Increment Financing Commission to
construct the three phases of stormwater improvements in this area; NOW,
THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Water Services is hereby authorized to execute an Agreement for
Stormwater Control Improvements with Universal Land Development Co., L.P. and
the Tax Increment Financing Commission of Kansas City, Missouri.
Section 2. That
the City Clerk is hereby directed to file copies of this ordinance, together
with the Agreement for Stormwater Control Improvements in the Office of the
Recorder of Deeds of Jackson County, Missouri.
Section 3. That
the appropriation in the following account of the Wastewater Series 2006A Fund
is hereby reduced by the following amount:
AL-8182-807790-B Sewers $850,000.00
Section 4. That
the sum of $850,000.00 is hereby appropriated from the Unappropriated Fund
Balance of the Wastewater Series 2006A Fund to the following account in the
Wastewater Series 2006A Fund:
AL-8182-808081-B Water
& Sewer CD1 $850,000.00
Section 5. That
the Director of Water Services is hereby designated as requisitioning authority
for Account No. AL-8182-808081.
Section 6. That
the Director of Water Services is further authorized to expend up to the sum of
$850,000.00, from funds appropriated above, to satisfy the cost of this
contract.
Section 7. That
upon completion of the final costs of this contract, the Director of Finance is
hereby authorized to return the unexpended portion of this appropriation to the
Unappropriated Fund Balance from which it was derived.
Section 8. That this ordinance is recognized as an emergency
measure within the provisions of Section 503 of the City Charter in that it
appropriates funds and shall take effect in accordance with that section.

I hereby certify that
there is a balance, otherwise unencumbered, to the credit of the appropriation
to which the foregoing expenditure is to be charged, and a cash balance,
otherwise unencumbered, in the treasury, to the credit of the fund from which
payment is to be made, each sufficient to meet the obligation hereby incurred.
