ORDINANCE NO. 910132

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2362, rezoning an area of approximately 9.5 acres located on the east side of Cleveland Avenue on both sides of 51st Street from District R-5 (High Apartment) to District PD/R-5 (Planned District/High Apartment), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2362, rezoning an area of approximately 9.5 acres located on the east side of Cleveland Avenue on both sides of 51st Street from District R-5 (high apartment) to District PD/R-5 (planned district/ high apartment), said section to read as follows:

 

Section 65.010A2362. That an area legally described as:

 

All that part of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 27, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows:

 

Beginning at the intersection of the East line of Cleveland Avenue with the Southerly line of U.S. Highway No. 50 (also known as Blue Parkway); thence South along the East line of Cleveland Avenue to its intersection with the Northerly line of 51st Street; thence East along the Northerly line of 51st Street to a point 359.27 feet West of the East line of said Quarter Quarter Section; thence North 0 degrees 05 minutes 30 seconds East and parallel to the East line of said 1/4 1/4 Section, 245.0 feet; thence North 48 degrees 43 minutes 50 seconds East 66.62 feet to a point 319 feet North of the South line and 309.27 feet West of the East line of said 1/4 1/4 Section; thence North 0 degrees 05 minutes 30 seconds East and parallel to the East line of said 1/4 1/4 Section, 31.0 feet; thence North 89 degrees 56 minutes East and parallel to the South line of said 1/4 1/4 Section, 17.0 feet; thence North 27 degrees 28 minutes 25 seconds East, 82.63 feet to a point 423.35 feet North of the South line of 254.27 feet West of the East line of said 1/4 1/4 Section; thence North 0 degrees 07 minutes West, 274.86 feet to a point on the South line of U.S. Highway No. 50 that is 270.85 feet Northwesterly of the East line of said 1/4 1/4 Section, measured along said South line of U.S. Highway No. 50; thence Northwesterly along the South line of U.S. Highway No. 50 to point of beginning, except those portions of said tract described in Tracts 1, 2, 3, 4 and 5 as follows:
TRACT ONE: All that part of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 27, Township 49, Range 33, Kansas City, Jackson County, Missouri, described as follows: Beginning at the intersection of the East line of Cleveland Avenue with the Southerly line of U.S. Highway No. 50; thence Southeasterly along said Southerly line, a distance of 113.91 feet; thence Southwesterly at right angles to the Southerly line of U.S. Highway No. 50, a distance of 117.74 feet; thence Northwesterly and parallel to said Southerly line, a distance of 71.93 feet to the East line of Cleveland Avenue; thence North, a distance of 125.0 feet to the point of beginning.

 

TRACT TWO: All that part of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 27, Township 49, Range 33, Kansas City, Jackson County, Missouri, described as follows: Beginning at a point in the Southerly line of the right of way of U.S. Highway No. 50 and 113.91 feet Easterly of, measured along the Southerly line of said Highway, the East line of Cleveland Avenue, as said roadways are now established; thence Southeasterly along the Southerly line of U.S. Highway 50, a distance of 200.0 feet; thence South and parallel to the East line of Cleveland Avenue, a distance of 337.48 feet; thence West at right angles to the last described course, a distance of 188.38 feet to a point of 107.29 feet East of the East line of Cleveland Avenue, thence North and parallel to the East line of Cleveland Avenue, a distance of 263.75 feet; thence West at right angles to the last described course, a distance of 56.36 feet; thence Northwesterly and parallel to the Southerly line of U.S. Highway No. 50, a distance of 54.07 feet to the East line of Cleveland Avenue at a point 161.0 feet due South of the South line of U.S. Highway No. 50; thence North along the East line of Cleveland Avenue, a distance of 36.0 feet; thence Southeasterly and parallel to the Southerly line of U.S. Highway No. 50, a distance of 71.93 feet; thence Northeasterly at right angles to the Southerly line of U.S. Highway No. 50, a distance of 117.74 feet to the point of beginning.

 

TRACT THREE: All that part of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 27, Township 49, Range 33, Kansas City, Jackson County, Missouri, described as follows: Commencing at the Southwest corner of Tract 2 as hereinbefore set forth; thence North and parallel to the East line of Cleveland Avenue a distance of 263.75 feet; thence West at right angles to the last described course, a distance of 56.36 feet; thence Northwesterly and parallel to the Southerly line of U.S. Highway No. 50, a distance of 54.07 feet to the East line of Cleveland Avenue at a point 161.0 feet due South of the South line of U.S. Highway No. 50; thence South along the East line of Cleveland Avenue to a point on Cleveland Avenue directly West of the point of beginning; thence straight East a distance of 107.29 feet to the point of beginning.

 

TRACT FOUR: All that part of the Southeast 1/4 of the Southeast 1/4 of Section 27, Township 49, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Beginning at a point on the Southerly line of U.S. Highway No. 50 and 313.91 feet Southeasterly of the East line of Cleveland Avenue, measured along the Southerly line of U.S. Highway No. 50 thence South and parallel to the East line of Cleveland Avenue, 662.45 feet; thence North 89 degrees 56 minutes East, 312.33 feet; thence South 48 degrees 14 minutes East, 393.17 feet to a point 30 feet North of the South line of said 1/4 1/4 Section; thence South 89 degrees 56 minutes East and parallel to the South line of said 1/4 1/4 Section, 6.44 feet to a point 359.27 feet West of the East line of said 1/4 1/4 Section; thence North 0 degrees 05 minutes 30 seconds East and parallel to the East line of said 1/4 1/4 Section, 245.0 feet; thence North 48 degrees 43 minutes 50 seconds East, 66.62 feet to a point 319 feet North of the South line and 309.27 feet West of the East line of said 1/4 1/4 Section, thence North 0 degrees 05 minutes 30 seconds East and parallel to the East line of said 1/4 1/4 Section 31.0 feet; thence North 89 degrees 56 minutes East and parallel to the South line of said 1/4 1/4 Section 17.0 feet; thence North 27 degrees 28 minutes 25 seconds East, 82.63 feet to a point 423.35 feet North of the South line and 254.27 feet West of the East line of said 1/4 1/4 Section; thence North 0 degrees 07 minutes West, 274.86 feet to a point on the South line of U.S. Highway No. 50 that is 270.85 feet Northwesterly of the East line of said 1/4 1/4 Section, measured along said South line of U.S. Highway No. 50; thence North 70 degrees 22 minutes 30 seconds West along said South line, 761.89 feet to the point of beginning; except a tract described as follows: Beginning at the intersection of the Southerly line of U.S. Highway No. 50 and the East line of the above described tract; thence Southerly along the East line of the above described tract 150 feet; thence parallel to the Southerly line of U.S. Highway No. 50 Northwesterly 105 feet; thence parallel to the East line of the above described tract Northerly 150 feet to a point in the Southerly line of U.S. Highway No. 50; thence Southeasterly 105 feet to the point of beginning.

 


TRACT FIVE: Part of the Southeast 1/4 of the Southeast 1/4 of Section 27, Township 49, Range 33, more particularly described as follows: Beginning at the intersection of the Southerly line of U.S. Highway No. 50 and the East line of a tract, which point is 1075.80 feet measured Southeasterly from the intersection of U.S. Highway No. 50 and Cleveland Avenue, Kansas City, Jackson County, Missouri, thence Southerly along said East line 150 feet, thence parallel to the Southerly line of U.S. Highway No. 50 Northwesterly 105 feet; thence parallel to the East line of the tract Northerly 150 feet to a point in the Southerly line of U.S. Highway No. 50, thence Southeasterly along U.S. Highway No. 50, 105 feet to the point of beginning.

 

ALSO: (1) That part of Lot 8 lying West of the Westerly line of Mersington Avenue and South of the South line of 51st Street, and (2) that part of Lot 7 lying South of the South line of 51st Street Terrace and North of the North line of 52nd Street and East of the East line of Mersington Avenue and West of the West line of Myrtle Avenue, in the Mount Cleveland Addition in Kansas City, Jackson County, Missouri.

 

ALSO: All of that part of Lot 8 lying South of the Southerly line of 51st Street Terrace and East of the Easterly line of Mersington and West of the Westerly line of Myrtle Avenue, in the Mount Cleveland Addition in Kansas City, Jackson County, Missouri.

 

 

is hereby rezoned from District R-5 (high apartment) to District PD/R-5 (planned district/high apartment), all as shown outlined on a map marked Section 65.010A2362, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer including provision for any needed

improvements.

 


3. That the developer dedicate additional right of way for Myrtle Street and improve the west half of Myrtle Street

to City standards for residential streets or in lieu

thereof, petition the City for the vacation of such

street.

 

4. That the developer construct a cul-de-sac at the proposed termination of 51st Street.

 

5. That the developer petition for the vacation of the remaining portion of 51st Street and Mersington Street

within the subject property.

 

6. That the developer construct a left turn lane within the Cleveland Avenue right of way when Phase II is built.

 

7. That the developer extend water mains in accordance with City standards and regulations.

 

A copy of said development plan is on file in the Office of the City Clerk under Document No. 910132 which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
