COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120944

 

Authorizing the Director of Human Relations to create and implement a Hiring Bid Incentive Program to motivate companies to create employment opportunities as part of a targeted building demolition effort.

 

WHEREAS, to improve the livability of our neighborhoods a targeted building demolition effort has begun;

 

WHEREAS, as part of this targeted demolition effort new employment opportunities can be created;

 

WHEREAS, contractors will be provided an opportunity to participate in a Hiring Bid Incentive Program to create new employment opportunities for candidates associated with the Full Employment Council; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Director of the Human Relations Department is authorized to implement a Hiring Bid Incentive Program, allowing a bid incentive of not more than three (3%) percent for any demolition contractor that hires at least two additional employees that may be eligible for benefits, for each demolition contract that is awarded in the targeted demolition area and the funding is pursuant to Ordinance 120808.  The employees shall be hired thorough the First Source Hiring Program with the Full Employment Council. Any bid eligible for the bid incentive shall be adjusted for evaluation purposes by reducing the bid by the percentage of the incentive. This adjustment shall be used solely for the purpose of establishing the apparent low bidder. The actual value of the contract shall be the amount of the actual bid submitted by the contractor.

 

Section 2. That any contract containing such a bid incentive shall provide that City may recover from the demolition contractor, as liquidated damages, the amount of any bid incentive allowed in the event the demolition contractor fails to hire such additional employees. This shall not preclude the recovery of any other damages otherwise applicable.
