ORDINANCE NO. 960212

Authorizing the Director of Public Works, on behalf of the City to execute as grantee and agree to the terms therein, an Easement for Public Road or Street located on the Longview Lake Government Reservation as offered by the Department of the Army, Corps of Engineers, said public roads or streets being within the boundaries of Kansas City, Jackson County, Missouri and located on said Government Reservation, and directing the City Clerk to record the easement with the Secretary of State and the County Recorder of Deeds.

WHEREAS, the Council finds that it did, by Ordinance No. 48502, passed November 23, 1977, authorize a four party agreement between the United States of America, the cities of Grandview, Lee's Summit and Kansas City relating to the rearrangement of streets in the area of Raytown Road and 109th Street; and

WHEREAS, the Federal Contract Number DACW 41-77-C-0106, being the said four party agreement, was entered into by the City on December 15, 1977; and

WHEREAS, the Council finds that it did by Ordinance No. 49021, passed April 21, 1978, authorize a four party agreement with Jackson County, Lee's Summit, Grandview and Kansas City to relocate, alter, and rearrange streets in the Longview Lake project; and

WHEREAS, the Council finds that it did by Ordinance No. 920894, authorize the execution of a Quit Claim Deed and Subordination Agreement releasing street rights-of-way within the boundaries of Longview Lake Park; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is hereby authorized, on behalf of the City to execute as grantee and agree to the terms therein, an Easement for Public Road or Street located on the Longview Lake Government Reservation as offered by the Department of the Army, Corps of Engineers, said public roads or streets being within the boundaries of Kansas City, Jackson County, Missouri and located on said Government Reservation. The easement shall be essentially in the form which is attached and incorporated herein by reference.

Section 2. That the City Clerk is hereby directed to record copies of the executed easement in the office of the Secretary of State for the State of Missouri and in the office of the Director of Records for Jackson County, Missouri at Kansas City as directed by Missouri State Statute 70.300.
