ORDINANCE NO. 061401

 

Approving a preliminary plat of 4646 Broadway Condominiums on approximately a 0.24 acre tract of land generally located at 4646 Broadway. (SD 1285)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of 4646 Broadway Condominiums on approximately a 0.24 acre tract of land generally located at 4646 Broadway, and more specifically described as follows:

 

All that part of Lot 24, HOME PLACE, a subdivision in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the Northwest corner of said Lot 24, HOME PLACE; thence South 02 degrees 17 minutes 31 seconds West along the West line of said Lot 24 a distance of 66.67 feet to the Point of Beginning; thence South 87 degrees 32 minutes 00 seconds East a distance of 89.29 feet to the West right-of-way line of Broadway as now established; thence South 02 degrees 17 minutes 19 seconds West along the West right-of-way line of Broadway a distance of 116.67 feet; thence North 87 degrees 32 minutes 00 seconds West a distance of 89.30 feet to a point on the West line of said Lot 24; thence North 02 degrees 17 minutes 31 seconds East along the West line of said Lot 24 a distance of 116.67 feet to the Point of Beginning.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer secure permits to repair sidewalks, curbs and gutters as necessary along the development street frontage as required by the City Development Departments Development Services group in accordance with Chapters 56 and 64, Code of Ordinances, prior to recording of the plat.

 

3.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas.

 

4.                  That the developer receive the approval of the Board of Zoning Adjustment for a conditional use permit to allow for any proposed signage advertising the name and/or use of the property.

 

5.                  That the developer contribute $2,151.71 in-lieu-of parkland dedication for 18 multi-family units in satisfaction of Section 66-128 of the Subdivision Regulations at a rate of $9,961.61, per acre.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
