ORDINANCE NO. 160210

 

Authorizing the City Manager to execute an Intergovernmental Agreement with the Land Bank of Kansas City, Missouri to support and undertake administrative and operational staffing and other services on behalf of the Land Bank.

 

WHEREAS, Revised Missouri Statutes Section 141.980 permitted the City to establish by ordinance a land bank agency for the management, sale, transfer, and other disposition of interests in real estate owned by such land bank agency; and

WHEREAS, on September 20, 2012, the City passed Committee Substitute for Ordinance No. 120779 (“Authorizing Ordinance”) establishing the Land Bank of Kansas City, Missouri (“Land Bank”); and

WHEREAS, it is in the best interests for the health, safety and welfare of the citizens of the City to efficiently and effectively implement and support the Land Bank during its initial period of operation and to enter into an Intergovernmental Cooperative Agreement to achieve that interest; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Manager is hereby authorized to execute, an Intergovernmental Agreement with the Land Bank outlining the terms and conditions by which the City will support and undertake administrative and operational staffing and other services for the benefit of the Land Bank. Such Intergovernmental Agreement will be substantially in the form on file with this Ordinance and a copy of the Agreement, once signed by the Land Bank and the City Manager, will be on file with the Director of Neighborhoods and Housing Services.

Section 2. That upon the adoption of the City’s budget for the fiscal year starting May 1, 2016, the City Manager will advise the Land Bank of the funds allocated to it for use upon the terms and conditions set forth in the Intergovernmental Agreement.

Section 3. That the Intergovernmental Agreement will be for an initial term not to exceed April 30, 2019, subject to termination within sixty (60) days’ notice, and further subject to the appropriations of funds by the City as more fully set forth in the Intergovernmental Agreement.

Section 4. That the Intergovernmental Agreement will automatically renew for an additional one year term commencing on the first day of the fiscal year unless either party elects to not renew the Agreement at least sixty (60) days prior to the termination date.
