COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 950373

 

Approving an amendment to a previously approved Community Unit Project on approximately an 11.45 acre tract of land generally located south of Truman Road between Jackson Avenue and Cleveland Avenue. (7461-CUP-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on approximately an 11.45 acre tract of land generally located south of Truman Road between Jackson Avenue and Cleveland Avenue, and more specifically described as follows:

 

All of Lots 23 thru 31, inclusive, east 13 feet of Lot 32, west 12 feet of Lot 34, all of Lots 35 thru 44, inclusive, Block 1; all of Lots 1 thru 23, inclusive, and all of Lots 27 through 56, inclusive, (including all vacated alleys adjoining said lots), Block 2; and all of Lots 1 thru 34, inclusive, Block 3, Blue Avenue Park.

 

A tract of land with 50 foot frontage on the north line of 17th Street lying east of and adjoining the east line of Block 3, Blue Avenue Park, lying with SE 1/4, SE 1/4, Section 3-49-33.

 

All of Lots 13 thru 18, inclusive, Block 1; and all of Lots 1 thru 11, inclusive, and the north 40.3 feet of Lot 12, Block 2, Kensington.

 

All of Lot 1 (including vacated alley lying north of and adjoining Lot 1) and all of Lots 2, 3 and 4, Middle West Investment Co. First Addition.

 

All of Lots 1 thru 6, inclusive, W.T. Davis First Addition.

 

A tract of land with a 208.7 foot frontage on west line of Jackson Avenue north of and adjoining north line of W.T. Davis First Addition, lying within SE 1/4, SE 1/4, Section 3-49-33.

 

All of Lots 1 through 4, inclusive, and Lots 13 thru 48, inclusive, Redfield Place.

 

All of Lots 1 thru 184, inclusive (except those parts of said lots within alleys and streets), Owings Place.

 

All of Lots 1 thru 145, inclusive (including vacated alleys adjoining said lots but excluding those parts of said lots lying within alleys and streets), Haverhill.

 

All lying within Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval for the entire development when the first plat is submitted and that the

developer make any necessary improvements as required by the City Engineer's

Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer construct sidewalks on all perimeter and interior streets.

 

5. That the developer submit a street name sign plan to the Department of Public Works for approval.

 

6. That the developer submit covenants, conditions and restrictions to the Law Department for approval.

 

7. That the developer petition for the vacation of all alleys and streets as required by the City Engineer's Office.

 

8. That the developer secure the approval of the Street Naming Committee for all street names.

 

9. That the developer construct hard-surface roads and provide for fire protection prior to construction beyond foundations.

 

10. That the developer provide for fire protection as required by the Fire Department.

 

11. That the developer plat Tracts I and II at the same time.

 

12. That the developer extend water mains as required by the Water Department.

 

13. That the developer provide parking as required by the Zoning Ordinance or receive approval from the Board of Zoning Adjustment for any parking variances for Tract

III.

 

14. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the entire development exceeds five acres.

 

15. That the developer submit a final plan to the City Plan Commission for approval, including information on signage, landscaping and screening.

 

16. That the developer submit a street planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way in front of

residential lots.

 

A copy of said Community Unit Project amendment is on file in the office of the City Clerk under Document No. 950373, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
