ORDINANCE NO. 051124

 

Approve the First Amendment to the BMA-Landmark Tower Urban Renewal Plan for approximately 7.3 acres generally located at the northeast corner of 31st Street/Karnes Boulevard and Southwest Trafficway. (613-S-1)

WHEREAS, by passage of Ordinance No. 041018, passed September 30, 2004, the City Council approved a general urban renewal plan for the BMA-Landmark Tower Urban Renewal Project; and

 

WHEREAS, it is desirable and in the public interest that the BMA-Landmark Tower Urban Renewal Plan be modified allow for 224 residential units and a 6,000 square foot retail/restaurant; and

 

WHEREAS, a copy of the amendment has been filed with the City Clerk; and

 

WHEREAS, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, did on July 27, 2005, adopt Resolution No. 7-06-05 recommending approval of the First Amendment to the BMA-Landmark Tower Area to allow for 224 residential units and a 6,000 square foot retail/restaurant; and

 

WHEREAS, the City Plan Commission reviewed the First Amendment to the BMA-Landmark Tower Urban Renewal Plan to allow for 224 residential units and a 6,000 square foot retail/restaurant, said recommendation of the City Plan Commission being set forth on Exhibit A attached hereto and incorporated herein by reference; and

 

WHEREAS, the plan with this modification is feasible and in conformity with the general plan for the City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the First Amendment to the BMA-Landmark Tower Urban Renewal Plan, which allows for 224 residential units and a 6,000 square foot retail/restaurant, is hereby approved. A copy of the First Amendment to the BMA-Landmark Tower Urban Renewal Plan is on file with the office of the City Clerk and is incorporated herein by reference.

 

Section B. That the Council has duly made the findings necessary for compliance with Sections 99.320 to 99.430, Revised Statutes of Missouri, as amended.

 

Section C. That it is hereby found and determined that all of the findings, determinations and conclusions made and set forth in the previous ordinances listed above apply with equal force and effect as of the date of this revision.

 

Section D. That said Urban Renewal Plan and amendments are hereby found to be feasible and in conformance with the Master Plan for the development of the community as a whole.
