COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 080540

 

Stating the intention of the Council to include in all new development plans and projects receiving economic incentives from the City and amendments thereto, a requirement that a portion of the plan or project area accessible by the general public be made available as a designated space for public initiatives; and requesting the Tax Increment Financing Commission of Kansas City, Missouri, Land Clearance for Redevelopment Authority of Kansas City, Missouri, Planned Industrial Expansion Authority of Kansas City, Missouri, and the City Manager to implement this policy.

 

WHEREAS, development plans and projects frequently receive public economic incentives; and

 

WHEREAS, publicly supported projects should provide amenities for the citizens who directly or indirectly contribute tax dollars for such projects; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council intends to include, in all new retail redevelopment plans and projects receiving economic incentives approved or recommended for approval by the Tax Increment Financing Commission of Kansas City, Missouri, the Planned Industrial Expansion Authority of Kansas City, Missouri, the Land Clearance for Redevelopment Authority of Kansas City, Missouri, the Economic Development Corporation of Kansas City, Missouri, (Redevelopment Agencies) and the City Manager, and amendments involving new construction or new projects, (collectively, Incented Projects), a requirement that a portion of the area accessible by the general public, if any, within the plan or project area shall be designated as a space for the purpose of soliciting and collecting signatures and support for initiative petitions and voter registration (Initiative Petition Designations). The requirement for Initiative Petition Designations shall only be applicable to retail portions of development projects and shall contain the following requirements:

 

(a) The developer must designate an area not less than 10 feet by 10 feet as a space for the purpose of soliciting and collecting signatures and support for initiative petitions and voter registration.

 

(b) Such area must be no farther than 25 feet from the main entrance of the retail facility and at least 5 persons must be allowed to solicit and collect signatures and support for the petitions in such area.

 

(c) Solicitation and collection of signatures for initiative petitions and voter registration must be allowed during the regular business hours of the retail facility.

 

Section 2. The Council does not intend to approve any new Incented Projected which does not include Initiative Petition Designations.

Section 3. That the Redevelopment Agencies and the City Manager are hereby requested to include Initiative Petition Designations in agreements for all Incented Projects. Furthermore, the Redevelopment Agencies and the City Manager are requested to encourage developers of existing plans and projects to amend their existing contracts to provide for the addition of Initiative Petition Provisions.
