RESOLUTION NO. 120043

 

Calling for the joint establishment of one or more Transportation Development Districts with the Port Authority of Kansas City, Missouri, for the purpose of implementing and funding the design, engineering, construction and operation of a downtown streetcar.

 

WHEREAS, the City participated in the conduct of an alternatives analysis for a downtown mass transit circulator; and

 

WHEREAS, the consultant team that conducted such alternatives analysis recommended that the downtown mass transit circulator be a modern streetcar operating generally on Main Street between Pershing Road on the south and the Rivermarket area on the north, and the City Council adopted the same as the City’s preferred mode and route in Resolution No. 110764; and

 

WHEREAS, the implementation of the streetcar project contemplates the pursuit of federal financial assistance and a local financial commitment that is intended to be met through the formation and operation of one or more Transportation Development Districts (a “TDD”) formed pursuant to Sections 238.200, et. seq., RSMo, as amended (the “TDD Act”), with boundaries encompassing (subject to further refinement or expansion) all or a portion of the area outlined on the attached Exhibit A; and

 

WHEREAS, it is necessary to proceed with the formation of such TDDs so that the project can be best positioned to secure federal financial assistance; and

 

WHEREAS, Section 238.207.5 of the TDD Act provides that a petition seeking the formation of a TDD may be filed in the appropriate Circuit Court by a “local transportation authority” (as defined in the TDD Act) if two or more local transportation authorities have adopted resolutions calling for the joint establishment of a TDD; and

 

WHEREAS, the Port Authority of Kansas City, Missouri (the “Port Authority”) is a local transportation authority with jurisdiction over certain transportation/transit improvements within the proposed boundaries of the TDDs; and

 

WHEREAS, the Port Authority is expected to adopt a resolution calling for the joint establishment with the City of the TDDs that are the subject of this Resolution; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City of Kansas City, Missouri, as a local transportation authority, calls for the joint establishment with the Port Authority of one or more transportation development districts in the manner provided for in Section 238.207.5, RSMo, to implement the downtown streetcar project.

 

Section 2. That upon the adoption by the Port Authority of a resolution calling for the joint establishment with the City of the TDDs contemplated hereby, the Mayor is authorized to cause the preparation and filing, in the name and on behalf of the City, of a petition seeking the formation in accordance with the TDD Act of the one or more TDDs contemplated hereby, in such form and with such specific boundaries and revenue sources as are determined by the Mayor and described in a communication by the Mayor to the Council.

 

Section 3. That the City recognizes that pursuant to the TDD Act, the decisions to approve the formation of such TDDs, and to approve the specific types of revenue and rates thereof, require the affirmative vote of the “qualified voters” (as defined in the TDD Act) voting thereon at elections to be conducted in the future for such purposes, and that neither the adoption of this resolution, nor judicial approval of the formation petition(s) for such TDDs, will by themselves cause the formation of such TDDs or the approval of the specific types of revenue and rates thereof.
