ORDINANCE NO. 190417, AS AMENDED

 

Approving a $2,500,000.00 contract with McCown Gordon Construction to construct the Kansas City Law Enforcement Memorial Garden and appropriating the same amount therefor; estimating revenue in the amount of $850,000.00; reducing certain appropriations by $842,957.60; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, Ordinance No. 180123 authorized the Director of General Services to enter into a Cooperative Agreement with the Kansas City Police Officers Memorial Foundation for the funding, construction and maintenance of the Law Enforcement Memorial on City owned property in recognition of the Kansas City Metropolitan Area Law Enforcement Officers who gave their lives in the line of duty and directed the City Manager to set aside $600,000.00 of in-district PIAC funds over a period of two years into a separate account for the Memorial; and

 

WHEREAS, McCown Gordon has submitted a Final Guaranteed Maximum Price for construction of this memorial and related site work in the amount of $2,500,000.00; and

 

WHEREAS, private fundraising has raised $350,000.00 and there are additional monetary commitments committed over the next 24 months in the amount of $500,000.00; and

 

WHEREAS, the City commits $500,000.00 in Citywide PIAC dollars to start construction of the project with the understanding that this would be repaid back to the City with corporate and other donations. In the event that this fundraising target has not been met any shortfall would be repaid with First District PIAC Neighborhood Conservation Funds; and

 

WHEREAS, the City entered into a Cooperative Agreement with Kansas City Police Officers Memorial Foundation, a Missouri non-profit corporation registered with the United States Internal Revenue Service as a tax-exempt public charity organization eligible to receive tax-deductive charitable contributions (“Foundation”) for the purpose of soliciting, administering and holding donations sufficient to fund the future construction and maintenance of a law enforcement memorial on City owned property in recognition of the Kansas City Metropolitan area Law Enforcement Officers who gave their lives in the line of duty (“Memorial”); and

 

WHEREAS, Kansas City Police Officers Memorial Foundation will act as Project Manager for the Memorial’s initial two years of implementation to fund the design, planning and construction phase, and will take the lead in structuring, coordinating, fundraising and managing development of a $3-$3.5 million fundraising effort; and

 

WHEREAS, the Law Enforcement Memorial Committee is dedicated to constructing this memorial in close proximity of the Kansas City Regional Police Academy. The Committee will work in partnership with the KC Police Memorial Foundation, the Kansas City, Missouri Board of Parks and Recreation Commissioners, area law enforcement agencies, private citizens and the City of Kansas City, Missouri to design, build, and endow a Memorial worthy of the sacrifice made by these public servants. NOW, THEREFORE, 

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of General Services is authorized to execute a $2,500,000.00 contract with McCown Gordon Construction for the construction of the Kansas City Law Enforcement Memorial Garden and is hereby designated as requisitioning authority for Account No. 20-3090-078021.

 

  Section 2. That revenue in the following accounts in the Capital Improvements Sales Tax Fund are hereby estimated in the following amounts:

 

20-3090-078021-488110-07001219 Contribution for KCLEMG $ 500,000.00

20-3090-078021-481000-07001219 Contribution for KCLEMG 350,000.00

  TOTAL $ 850,000.00

 

 Section 3. That the appropriations in the following accounts in the Capital Improvements Sales Tax Fund are hereby reduced by the following amounts:

 

20-3090-078102-B-07001219 Contribution from District 1 $ 192,957.60

20-3090-078202-B-07001219 Contribution from District 2 100,000.00

20-3090-078302-B-07001219 Contribution from District 3 100,000.00

20-3090-078402-B-07001219 Contribution from District 4 100,000.00

20-3090-078925-B-07001219 Contribution from District 5 100,000.00

20-3090-078826-B-07001219 Contribution from District 6 97,210.00

20-3090-708109-B-70178901 Contribution from District 1 150,000.00

TOTAL $ 842,957.60

 

Section 4. That the following amount is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvement Sales Tax Fund to the following account:

 

20-3090-078021-B-07001219 KCLEMG $2,500,000.00

 

  Section 5. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the Charter, and shall take effect in accordance with Section 503, City Charter.
