ORDINANCE NO. 080272

 

Approving a preliminary GP development plan in District GPA for approximately a 13.37 acre tract of land generally located on the west side of Raytown Road, approximately one-half mile south of I-470. (13846-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary GP development plan in District GPA (General Planned District, Agricultural) for approximately a 13.37 acre tract of land generally located on the west side of Raytown Road, approximately one-half mile south of I-470and more specifically described as follows:

 

Commencing at the southwest corner of the Southeast Quarter of Section 32, Township 48, Range 32, Kansas City, Jackson County, Missouri; thence South 8647'02" East, along the south line of said Southeast Quarter for 20.00 feet to the point of beginning; thence North 205'57" East, parallel to the west line of said Southeast Quarter for 475.07 feet; thence South 8647'02" East for 469.61 feet; thence South 242'02" West for 175.00 feet; thence South 8647'02" East for 431.90 feet to the west right of way line of Raytown Road; thence South 242'02" West, along said right of way line for 300.00 feet to the south line of said Southeast Quarter; thence North 8647'02" West, along said south line for 896.52 feet to the point of beginning, subject to that part in roads. also known as Lot 2 as shown on the Certificate of Survey recorded June 28, 1994 as Document No. I-1285999 in Book T-7 at page 75; and Lots 2 and 3, Clegg Acres, a subdivision of land in Jackson County, Missouri, as previously platted and recorded, except the west 200 feet of said Lot 3. Contains 13.37 acres, more or less, subject to existing encroachments, easements or restrictions of record.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer submit a detailed micro storm drainage study prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

2.                  That the developer pay impact fees as required by Chapter 39, Code of Ordinances.

 

3.                  That the developer secure permits to repair existing or reconstruct sidewalks, curbs, and gutters as necessary along all development street frontages in accordance with Chapters 56 and 64, Code of Ordinances, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curbs, and gutters are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by the Development Services, prior to issuance of a certificate of occupancy.

 

4.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

5.                  That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

6.                  That public sanitary sewer system need not be extended provided that the developer demonstrates that the existing private sewage disposal system complies with Chapter 18, Kansas City Building and Rehabilitation Code, Code of Ordinances, at the time of each application for building permits which may add plumbing fixtures.

 

7.                  That the developer grant a BMP Easement to the City as required by Development Services, prior to issuance of a certificate of occupancy.

 

8.                  That the developer submit a final plan to the City Plan Commission for approval including grading, landscaping, signage, fencing and lighting plan with a photometric study showing zero footcandles at the lot lines.

 

9.                  That the developer obtain approval from the Board of Zoning Adjustments if required for any signage.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
