Approving the preliminary plat of
Atriums at Soho West on an approximately 0.305 acre tract of land generally
located at 612 Central Street. (SD 1130).
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That the preliminary
plat of Atriums at Soho West on an approximately 0.305 acre tract of land
generally located at 612 Central Street (northwest corner of 7th
Street and Central Street), and more specifically described as follows:
Lots 19 and 20,
except the South 89 feet thereof and all of Lots 21, 22 and 23, Block 7, KINGS
RESURVEY OF BLOCKS 5, 6, 7 AND 8, HUBBARDS ADDITION, a subdivision in said
Kansas City, Jackson County, Missouri, according to the recorded plat thereof,
being more particularly described as follows:
Beginning at the
Southeast corner of said Lot 23, being also the intersection of the Northerly
right-of-way line of 7th Street with the Westerly right-of-way line of Central
Street, as said streets are now both established; thence North 87 degrees 25
minutes 00 seconds West along the Southerly line of said Lots 23, 22 and 21,
being also along the Northerly right-of-way line of said 7th Street, a distance
of 74.98 feet (75 feet, Plat), more or less, to the Southwest corner of said
Lot 21, being also the Southeast corner of SOHO WEST, a condominium subdivision
in said City, County and State, according to the recorded plat thereof, thence
North 02 degrees 16 minutes 16 seconds East (N. 02 degrees 16 minutes 30 seconds
E., Plat), along the Easterly line of said SOHO WEST, being also along the
Westerly line of said Lot 21, a distance of 89.00 feet, more or less, to the
most East, Northeast corner of said SOHO WEST; thence North 87 degrees 25
minutes 00 seconds West (N. 87 degrees 24 minutes 46 seconds W., Plat), along a
jog in the Northerly line of said SOHO WEST, being also along a line 89 feet
North of and parallel with the Northerly right-of-way line of said 7th Street
and the Southerly line of said SOHO WEST, a distance of 49.98 feet, more or
less, to an angle point in the North line of said SOHO WEST, being also a point
on the West line of said Lot 19; thence North 02 degrees 16 minutes 27 seconds
East (N. 02 degrees 16 minutes 41 seconds E., Plat), along the Easterly line of
said SOHO WEST, being also along the Westerly line of said Lot 19, a distance
of 53.00 feet, more or less, to the most North, Northeast corner of said SOHO
WEST, being also the Northwest corner of said Lot 19 and a point on the
Southerly right-of-way line of a 16 feet wide alley, as now established; thence
South 87 degrees 25 minutes 00 seconds East along the Southerly right-of-way
line of said 16 feet wide alley, being also along the Northerly line of said
Lots 19, 20, 21, 22 and 23, a distance of 124.94 feet (125 feet, Plat), more or
less, to the Northeast corner of said Lot 23, being also the intersection of
the Southerly right-of-way line of said 16 feet wide alley with the Westerly
right-of-way line of said Central Street; thence South 02 degrees 15 minutes 51
seconds West along the Westerly right-of-way line of said Central Street, a
distance of 142.00, feet, more or less, to the Point of Beginning. Containing
13,295 square feet or 0.305 acres, more or less.
is hereby approved, subject to the following conditions:
1. That
the developer shall cause the area to be platted and processed in accordance
with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer secure permits to repair sidewalks, curbs and gutters as
necessary along all development street frontages as required by the Department
of Public Works in accordance with Chapters 56 and 64 of the Code of
Ordinances, prior to recording of the final plat.
3. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval for the maintenance of the common areas and private
open space.
4. That
the developer contribute $6,292.34 in lieu of parkland dedication for 41
condominium units in satisfaction of Section 66-128 of the Subdivision
Regulations.
5. That
the developer receive the approval of the Board of Zoning Adjustment for a
variance to the lot area and any other necessary variances.
A copy of the preliminary plat is on file in the office
of the City Clerk under Document No. 041253, which is attached hereto and made
a part hereof.
Section B. That the Council
finds and declares that before taking any action on the proposed preliminary
plat hereinabove, all public notices and hearings required by the Subdivision
Regulations have been given and had.
