ORDINANCE NO. 950699

 

Authorizing the Director of Public Works to enter into a second amendment to the agreement with the U.S. Army Corps of Engineers expanding the Turkey Creek Basin flood control study and to expend $200,000.00 therefor, and recognizing an emergency.

 

WHEREAS, by Ordinance No. 63673, passed February 16, 1989, the Council authorized an agreement with the United States of America, through its Corps of Engineers for a flood damage reduction feasibility study of the Turkey Creek Basin in the Southwest Boulevard area with a total City's obligation of $179,500.00; and

 

WHEREAS, by Ordinance No. 921065, passed October 1, 1992, the Council authorized an amendment to the previous agreement increasing the City's obligation to $525,000.00; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the attached second amendment to the agreement with the United States of America, through its Corps of Engineers, relating to a flood damage reduction feasibility study in Kansas City, Missouri, Project No. 3209, is hereby provided for and authorized. A copy of the amendment is attached and is incorporated herein by reference.

 

Section 2. That the Director of Public Works is hereby authorized to expend the sum of $200,000.00 from funds heretofore appropriated to Account No. 96-309-089-7203-T as and for the City's fiscal year 1995-96 share of the cost of the aforesaid feasibility study.

 

Section 3. That this ordinance, making provision for the immediate preservation of the public health and safety, is recognized to be an emergency measure within the provisions of Article II, Section 15 of the Charter of Kansas City, Missouri, and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
