ORDINANCE NO. 200774

 

Authorizing sale of 2.33 acres generally located along Van Brunt Boulevard along the north side of E. 17th Street, for the consideration of $31,500.00, which tract was removed from the City's park system pursuant to an election held on November 5, 2019; and directing the City Clerk to record this Ordinance with the Office of the Recorder of Deeds of Jackson County, Missouri.

 

WHEREAS, pursuant to Resolution No. 31462 by the Board of Parks and Recreation Commissioners, the Board determined, that the 2.33 acres generally located along Van Brunt Boulevard along the north side of E. 17th Street devoted to park use from the park system, was no longer necessary or appropriate for park, parkway, or boulevard use, and that such property could be removed from the park system by a vote of the people; and

 

WHEREAS, on June 6, 2019, the City Council passed Ordinance No. 190378 which authorized an election to be held to approve to remove the 2.33 acre tract by a vote of the people; and

 

WHEREAS, the election was held on November 5, 2019, and the voters approved removing the tract from the park system; and

 

WHEREAS, the City solicited bids for the purchase of the surplus property; and

 

WHEREAS, the City received one bid for the surplus property for $31,500.00 which met the advertised minimum bid of $31,500.00; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY, MISSOURI:

 

Section 1. That the Director of the Parks and Recreation Department is authorized to execute a Special Warranty Deed and any and all other real estate and closing documents as necessary to convey the City owned parcel to Kansas City Girls Preparatory Academy Foundation KCGPAF, legally described as:

 

In the vicinity of portion of Van Brunt Blvd. ROW north of 17th Street partially between Brighton and Hardesty. The sale includes part of Van Brunt Boulevard right of way, and being part of Vacated Lots 6, 7, 8, 9 and 18, and all of Vacated Lots 10 and 11, and part of Vacated Quincy Avenue, all of Jay H. Neff’s First Addition, a subdivision in Kansas City, Jackson County, Missouri, and all that part of an un-platted tract of land in the Southeast Quarter of Section 2, Township 49 North, Range 33 West, being in Kansas City, Jackson County, Missouri

 

in consideration for the payment of $31,500.00.


 

Section 2. That the City Clerk is directed to record with the Jackson County, Missouri Recorder of Deeds a certified copy of this ordinance.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
