ORDINANCE NO. 200072

 

Estimating the amount of $4,250,000.00 in the Capital Improvements Sales Tax Fund; appropriating that amount to the N.W. Prairie View Road 62nd to 64th Street; authorizing a $6,572,262.01 contract with Clarkson Construction Company for the N.W. Prairie View Road and South of 64th Street construction project; and authorizing a $274,764.00 amendment No. 5 to an inspection services contract with Affinis Corp., for a total contract amount of $1,504,119.00.

 

WHEREAS, on March 6, 2008, the City Council passed Ordinance No. 080150 modifying the City’s Major Street Plan in the vicinity of I-29 and N.W. Prairie View Road between N.W. 62nd Street and N.W. 72nd Street; and

 

WHEREAS, on March 6, 2014, City Council passed Ordinance No. 140153 supporting improvements to the Route 45 and I-29 interchange and directed the City Manager to work with the Missouri Department of Transportation for additional funding opportunities for the project; and

 

WHEREAS, in 2015, the City entered into a STP-Urban Agreement, No. STP 3374(402), with Missouri Highway and Transportation Commission (“MHTC”) securing a $2,750,000.00 grant for improvements to the Route 45 and I-29 interchange to relocate the western outer road south of Route 45; and

 

WHEREAS, on July 19, 2018, City Council passed Ordinance No. 180505 estimating and appropriating $1,426,643.55 of the City’s share of Platte County’s special road and bridge tax receipts for Fiscal Years 2014 and 2015 to the Project; and

 

WHEREAS, on November 29, 2018, City Council passed Ordinance No. 180901 approving an agreement with MHTC, wherein MHTC would contribute an additional $1,500.000.00 for construction of the outer road in the Project; and

 

WHEREAS, on August 22, 2019, City Council passed Ordinance No. 190645 estimating and appropriating $100,000.00 from the Developer Block & Company, Inc.’s contribution to the Project; and

 

WHEREAS, the City entered into an Indefinite Delivery Indefinite Quantity (IDIQ) contract with Affinis Corp. to provide inspection services for construction projects with the initial term beginning on September 1, 2017 and includes contract renewal option for four additional one-year terms; and

 

WHEREAS, Affinis Corp. contract has been amended four times pursuant to Ordinance Nos. 180422 and 190550; NOW, THEREFORE,


BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the revenue in the following account of the Capital Improvements Sales Tax Fund is estimated in the following amount:

 

20-3090-895112-477777-89008182 N.W. Prairie View Road 62nd to 64th $2,750,000.00

20-3090-895512-481000-89008182 N.W. Prairie View Road 62nd to 64th 1,500,000.00

TOTAL: $4,250,000.00

Section 2. That the sum of $4,250,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Sales Tax Fund in the following account of the Capital Improvements Sales Tax Fund:

 

20-3090-895112-B-89008182 N.W. Prairie View Road 62nd to 64th $2,750,000.00

20-3090-895912-B-89008182 N. W. Prairie View Road 62nd to 64th 1,500,000.00

TOTAL: $4,250,000.00

 

Section 3. That the Director of Public Works is hereby authorized to execute a contract with Clarkson Construction Company in the amount of $6,572,262.01 for construction services for the N.W. Prairie View Road and South of 64th Street project, from funds hereby and previously appropriated to the following accounts:

 

AL-3520-898021-B-89008182 N.W. Prairie View Road 62nd to 64th $2,000,000.00

20-3090-898012-B-89008182 N.W. Prairie View Road 62nd to 64th 222,262.01

20-3090-895112-B-89008182 N.W. Prairie View Road 62nd to 64th 2,750,000.00

20-3090-895912-B-89008182 N.W. Prairie View Road 62nd to 64th 1,600,000.00

TOTAL: $6,572,262.01

 

A copy of the contract is on file in the office of the Director of Public Works Department.

 

Section 4. That the Director of Public Works is hereby authorized to execute Amendment No. 5 to a contract with Affinis Corp. in the amount of $274,764.00 for inspection services in the N.W. Prairie View Road and S. of 64th Street project for a total contract amount of $1,504,119.00, from funds previously appropriated to the following account:

 

20-3090-898012-B-89008182 N.W. Prairie View Road 62nd to 64th $274,764.00

 

A copy of the contract amendment is on file in the Public Works Department.
