COMMITTEE SUBSTITUE FOR ORDINANCE NO. 190349

 

Rezoning an area of about 1.5 acres generally located at 905 and 909 W. 40th Terrace, 4102 Clark Avenue, and 4038 Clark Avenue from District R-5 to District R-0.75 to bring four multi-family buildings into zoning compliance. (CD-CPC-2019-00039)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1194, rezoning an area of approximately 202 acres generally 1.5 acres generally located at 905 and 909 W. 40th Terrace, 4102 Clark Avenue, and 4038 Clark Avenue from District R-5 (Residential 5) to District R-0.75 (Residential 0.75), said section to read as follows:

 

Section 88-20A1194. That an area legally described as:

 

South 30 feet of East 173.25 feet of Lot 7 and North 90 feet of East Half of Lot 8, Vogle's Louis Third Add, a subdivision in Kansas City, Jackson County, Missouri

 

and

 

South 80 feet of North 170 feet of East Half of Lot 8 and South 72 feet of North 242 feet of East Half of Lot 8, Vogle's Louis Third Add, a subdivision in Kansas City, Jackson County, Missouri

 

and

 

All of Lots 22 and 23, Quimby’s Addition, except that part of Lot 22 Lying East of the following described line: Beginning at a point on the south line of 40th Terrace, formerly Pitt Avenue, 66.15 feet west of the intersection of said south line with the west line of Madison Avenue; thence south 119 feet, more or less, to a point in the north line of an alley 60 feet west of the west line of said Madison Avenue, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof. 

 

is hereby rezoned from District R-5 (Residential 5) to District R-0.75 (Residential 0.75), all as shown outlined on a map marked Section 88-20A1194, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
