ORDINANCE NO. 080321

 

Accepting approximately 2.74 acres of vacant land contiguous to Indian Creek Greenway from Robert Smalley as an expansion to Indian Creek Greenway.

 

WHEREAS, it is the desire of the Board of Parks and Recreation Commissioners to enhance and expand open space and recreation opportunities by adding additions to the parks system; and

 

WHEREAS, an approximately 2.74 acre tract of vacant land contiguous to Indian Creek Greenway is being donated as an expansion to Indian Creek Greenway; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City, Missouri accepts approximately 2.74 acres and declares it to be park property and to remain such forever in accordance with provisions of Section 1004(a), of the Charter, as an addition to the Kansas City, Missouri, Parks Recreation and Boulevards park system. This tract being more particularly described as follows.

 

All that part of the Northeast of the Southeast of Section 29, Township 48, Range 33 and of Tract C, Holmes Gardens, all in Jackson County, Missouri, described as follows: Beginning at a point 358.75 feet South of and 40 feet East of the Northwest corner of the Northeast of the Southeast of Section 29, Township 48, Range 33, and running thence South, parallel with the West line of said section 381.25 feet to a point 200 feet North of the Northwest corner of Lot 41 in Holmes Wood Extension, a subdivision in Kansas City, Jackson County, Missouri; thence East, parallel with the North line of said Lot 41, a distance of 200 feet; thence South, parallel with the West line of said section, 100 feet; thence East, parallel to the North line of said Lot 41, a distance of 80 feet, to a point on the West line of Tract C, Holmes Gardens, a subdivision in Kansas City, Jackson County, Missouri, said point being 200 feet North of the Southwest corner of said Tract C; thence South along the West line of said Tract C, 200 feet to the Southwest corner thereof; thence Easterly, along the South line of said Tract C, 110.95 feet; thence North parallel with the West line of Tract C, 255.6 feet; thence West 110 feet to a point on the West line of said Tract C, said point being 241 feet North of the Southwest corner thereof; thence North, along said West line 287.58 feet to an angle point in said line; thence Northwesterly along a westerly line of said Tract C, 319.17 feet to the point of beginning.

 

Section 2. That upon the effective date of this ordinance, the City Clerk is hereby directed to record it in the Office of the Jackson County Recorder of Deeds in Kansas City, Missouri, as evidence of the acceptance of the land by Kansas City for public use for park purposes and the Council declares in accordance with the provision of Resolution No. 28212, adopted February 12, 2008, by the Board of Parks and Recreation Commissioners, that the land, in accordance with Section 1004(a) of the Charter of Kansas City, shall remain as part of the Parks system forever.
