ORDINANCE NO. 960220

 

Amending Chapter 2 of the Code of Ordinances by enacting within Article VI therein a new Division 9, entitled "Environmental Management Commission", consisting of new Sections 2-931 through 2-934, establishing an Environmental Management Commission.

 

WHEREAS, the City Council intends to replace the former Energy and Environment Commission and Waste Minimization Commission with a permanent Environmental Management Commission derived and continued from the current Environmental Management and Waste Minimization Commission; and

 

WHEREAS, the City Council finds that the current Environmental Management and Waste Minimization Commission began operation August 1, 1994, pursuant to the authority granted in Resolution No. 940657, with seventeen members appointed and serving as follows:

 

Five persons appointed by the Mayor (including a Chairman) for one year terms with their successors to serve for three year terms beginning August 1, 1995,

 

Six persons serving two year terms, each appointed by one of the six District Council members with their successors to be appointed August 1, 1996 and to serve thereafter for three year terms, and

 

Six persons serving three year terms, each appointed by one of the six At Large Council members with their successors to be appointed August 1, 1997 and to serve thereafter for three year terms; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 2 of the Code of Ordinances of Kansas City, entitled "Administration", is hereby amended by enacting within Article VI thereof, entitled "Boards, Commissions and Committees", a new Division 9, entitled "Environmental Management Commission", consisting of new Sections 2-931 through 2-934, said division and sections to read as follows:

 

DIVISION 9. ENVIRONMENTAL MANAGEMENT

COMMISSION

 

Sec. 2-931. Establishment; membership.

 

That an Environmental Management Commission is hereby established which shall be composed of seventeen (17) members.

 

Sec. 2-932. Appointment of members; term of office; vacancies.

 

A member shall be appointed by each of the six District Council members. A member shall be appointed by each of the six At Large Council members. The Mayor shall appoint five (5) members, one of which he shall designate as chairman of the commission.

 

Each member shall be a resident of the City and shall serve three (3) year terms beginning August 1 and until their successors are appointed and qualified. An appointment to fill a vacancy shall be similarly made, such appointee to serve the remainder of the term of the commissioner succeeded. The initial commission shall consist of the currently serving members of the Environmental Management and Waste Minimization Commission who shall continue to serve until the expiration of their current terms.

 

Sec. 2-933. Duties.

 

(a) The duties of the commission shall include:

 

(1) Reviewing plans, budgets, programs and actions of the City which

substantially impact the City's environment.

 

(2) Providing for the preparation of a comprehensive plan for addressing the long

term environmental needs of the City.

 

(3) Monitoring the City's actions for compliance with State and Federal

environmental laws and regulations.

 

(b) The commission shall be authorized to adopt rules to govern how it shall conduct its affairs.

 

(c) The commission shall make an annual report of its activities to the City Council.

 

(d) The commission shall meet a minimum of ten (10) times per year at a time and place determined by the commission.

 

Sec. 2-934. Staff.

 

The Director of the Office of Environmental Management or the Director's designee shall be an ex-officio member of the commission and shall provide clerical and administrative services for the commission.
