ORDINANCE NO. 041419

 

Authorizing a $41,344.40 First Amendment to Agreement No. 010337 with George Butler Associates, Inc., for engineering services in connection with 61st and North Wheeling sanitary sewer; reducing an appropriation in the amount of $41,345.00 in the Sewer Special Assessment Bond Fund 1991; appropriating it to the Sewers - 61st & North Wheeling account of the Sewer Special Assessment Bond Fund 1991; designating requisitioning authority; authorizing the Director of Public Works to expend $41,344.40 for the project; and authorizing assessment of properties benefitted by the project.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to enter into and execute, on behalf of the City, a $41,344.40 First Amendment to Agreement No. 010337 with George Butler Associates, Inc., essentially in the form attached hereto and incorporated herein by reference, relating to engineering services in connection with 61st and North Wheeling sanitary sewer, all in Kansas City, Missouri, Council District 1, Project No. 3406.

 

Section 2. That the appropriation in the following account of the Sewer Special Assessment Bond Fund 1991 is hereby reduced by the following amount:

 

05-3010-897742-B Sanitary Sewer Projects $41,345.00

 

Section 3. That the sum of $41,345.00 is hereby appropriated from the Unappropriated Fund Balance of the Sewer Special Assessment Bond Fund 1991 to the following account in the Sewer Special Assessment Bond Fund 1991:

 

05-3010-896157-B Sewers - 61st & North Wheeling $41,345.00

 

Section 4. That the Director of Public Works is hereby designated as requisitioning authority for Account No. 05-3010-896157.

 

Section 5. That the Director of Public Works is hereby authorized to expend the sum of $41,344.40 from funds heretofore appropriated to Account No. 05-3010-896157-B for the aforesaid First Amendment to Agreement No. 010337.

 

Section 6. That when the sewer system designed under this agreement is built, the cost of the design contract shall be included in the costs to be specially assessed against the benefitted properties in Sewer District Nos. 20014, 20015, 20016, 20017 and 20018 as provided in Article VIII of the City Charter, and the proceeds from the assessment of that cost shall be returned to the Sewer Special Assessment Fund.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
