 SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120722

 

Providing for submission to the qualified voters of the City for their approval at a general election on Tuesday, November 6, 2012, the question of whether to enact a $100.00 per sign face business license tax on outdoor advertising structures, authorizing and directing the City Clerk to notify the responsible election authorities of this election; and recognizing this ordinance to be an emergency measure.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. A general election is called, to be held on November 6, 2012, and at that general election the question of imposing the taxes described in this ordinance shall be submitted to the qualified voters of the City for their consideration.

 

Section 2. The ballot title shall be:

SHALL THE FOLLOWING BE APPROVED?

 

KCMO Business License Tax on Outdoor Advertising

In order to provide funds for beautification, outdoor advertising removal and enforcement, and other public improvement expenses, shall the City of Kansas City, Missouri impose a business license tax of $100.00 per sign face on outdoor advertising structures (billboards)? An outdoor advertising structure is an off-premises sign which directs attention to a business, commodity, service, activity, or product sold, conducted, or offered off the premises where such sign is located. This tax shall be in lieu of any other business license tax imposed by the City on outdoor advertising structures.

Section 3. ELECTION NOTICE. The Notice of Election shall read as follows:

CITY OF KANSAS CITY, MISSOURI

 

Notice is given to the qualified voters of the City of Kansas City, Missouri, that the City Council of the City has called a general election to be held in the City on November 6, 2012, commencing at 6:00 A.M. and closing at 7:00 P.M., on the questions contained in the following sample ballot:

Section 4. NOTICE TO ELECTION AUTHORITIES BY CITY CLERK. That following passage of this ordinance the City Clerk shall deliver certified copies of this ordinance and notice of election to the Clerk of Cass County, Board of Election Commissioners of Clay County, Board of Election Commissioners of Kansas City, and Board of Election Commissioners of Platte County, not later than August 28, 2012, which shall be the authority of each election authority of the City to submit the amendment to the electors of Kansas City and to give public notice as provided by law.

 

Section 5. EMERGENCY. This ordinance, calling for an election and providing for the submission of a question to the people of Kansas City, Missouri, is hereby recognized to be an emergency measure within the meaning of Section 503, Article V, of the Charter of Kansas City, and as such shall become effective upon approval by the Mayor or after five days of its passage if no action is taken by the Mayor to approve or veto this ordinance, whichever is earlier.
