Rezoning
an area of approximately 3.0 acres generally located at 8333 Blue Parkway Drive
on the west side of Blue Parkway Drive, from District C-1 to District PD/C-1,
and approving a development plan for the same. (5433-PD-9)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code of Ordinances of
the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is
hereby amended by enacting a new section to be known as Section 80-11A0699,
rezoning an area of approximately 3.0 acres generally located at 8333 Blue
Parkway Drive on the west side of Blue Parkway Drive, from District C-1
(Neighborhood Retail Business) to District PD/C-1 (Planned
District/Neighborhood Retail Business), said
section to read as follows:
Section
80-11A0699. That an area legally described as:
All that part of the
Northwest 1/4 of the Southeast 1/4 of Section 6, Township 48, Range 32, in
Kansas City, Jackson County, Missouri, described as follows: Commencing at the
Southeast corner of said 1/4 1/4 Section; thence North 893145 West, along
the South line of said 1/4 1/4 Section, a distance of 874.20 feet, to a point
450 feet East of the Southwest corner of said 1/4 1/4 Section, said point also
being the Southeast corner of a tract of land described in Book B-267 at Page
414, in the Office of the Recorder of Deeds for Jackson County, Missouri;
thence due North and parallel to the West line of said 1/4 1/4 Section, along
the East line of the above mentioned tract of land, a distance of 217.40 feet,
to the true point of beginning of the tract of land to be herein described,
thence continuing due North along said East line, a distance of 547.60 feet;
thence South 893145 East, and parallel to the South line of said 1/4 1/4
Section, a distance of 263.59 feet, to a point on the Southwesterly right‑of‑way
line of U.S. Highway No. 50 (as now established); thence South 491215 East,
along said Southwesterly right‑of‑way line, a distance of 200.00
feet; thence South 450057 West, a distance of 586.72 feet, to the point of
beginning. Containing 3.0 Acres, more or less.
is hereby rezoned from District C-1 (Neighborhood Retail Business) to District
PD/C-1 (Planned District/Neighborhood Retail Business), as shown
outlined on a map marked Section 80-11A0699, which is attached hereto and made
a part hereof, and which is hereby adopted as a part of an amendment to the
zoning maps constituting a part of said chapter and as an amendment to Section
80-11 thereof.
Section B. That a
development plan for the area legally described above is hereby approved, subject
to the following condition:
That the developer grant an
ingress/egress easement for the southeast drive if necessary prior to the
issuance of a certificate of occupancy.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section C. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
