ORDINANCE NO. 970968
Authorizing a $1,170,442.70 contract with Industrial
Excavating & Equipment, Inc., for constructing Southwest Boulevard
Streetscape - Phase II consisting of paving, curb and gutter, sidewalks storm
water inlets and other appurtenances; authorizing the Director of Public Works
to expend $1,340,000.00 in previously appropriated funds for the project; and
recognizing an emergency.
WHEREAS, the paving, curbing and gutters in the
Southwest Boulevard Streetscape are in need of repair and may pose threats to
vehicular and pedestrian traffic; and
WHEREAS, this condition presents an immediate threat
to public safety; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the work of constructing Southwest
Boulevard Streetscape - Phase II from Summit to I-35 Bridge, parking areas
below I-35 both north and south of Southwest Boulevard, Jefferson Street
between Southwest Boulevard and 24th Street, 24th Street between Summit and
Jefferson Streets, and the triangle north of Jones Store warehouse, consisting
of paving, curb and gutter, sidewalks, storm water inlets, and other
appurtenances in Kansas City, Jackson County, Missouri, Council District 2,
Project No. 1277, is hereby provided for and authorized.
Section 2. That the work shall be done in
accordance with the plans, specifications and the contract therefore between
Kansas City, Missouri, through its Director of Public Works, and Industrial Excavating
& Equipment, Inc., a Missouri corporation, in the amount of $1,170,442.70,
which contract is hereby approved and confirmed. A copy of the contract is on
file in the office of the Director of Public Works and is incorporated herein
by reference.
Section 3. That the Director of Public Works is
hereby authorized to expend the sum of $1,340,000.00 from funds previously
appropriated to Account No. 95-393-089-7209-T as and for consideration in the
aforesaid contract and for contingencies and engineering associated herewith.
Section 4. That this ordinance, making provision
for the immediate preservation of public safety, is declared to be an emergency
measure within the provisions of Article II, Section 15 of the Charter and
shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise
unencumbered, to the credit of the appropriation to which the foregoing
expenditure is to be charged, and a cash balance, otherwise unencumbered, in
the treasury, to the credit of the fund from which payment is to be made, each
sufficient to meet the obligation hereby incurred.
