ORDINANCE NO. 050674

 

Approving the preliminary plat of Plaza Hills Condominiums on a 1.47 acre tract of land generally located on the east side of Jarboe Street and extending approximately 523 feet south of W. 47th Street (4727 Jarboe Street). (SD 1164)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Plaza Hills Condominiums on a 1.47 acre tract of land generally located on the east side of Jarboe Street and extending approximately 523 feet south of W. 47th Street (4727 Jarboe Street), and more specifically described as follows:

 

Lots 2, 3, 4, 5, 6, 7, 8, 9, and 10, PENN PARK VIEW, and Lots 124, 125, and 126, PENN PARK, both being subdivisions in Kansas City, Jackson County, Missouri.

 

Also described as: Beginning at the Northwest corner of Lot 3, PENN PARK VIEW, a subdivision of record; thence S 872917E along the South right of way line of 47th Street (50r/w) for 88.36 feet to the Northeast corner of Lot 2, PENN PARK VIEW; thence S 23318W for 123.25 feet to the Southeast corner of Lot 2; thence S 872830E for 44.00 feet to the Northeast corner of Lot 4, PENN PARK VIEW; thence S 23318W for 400.00 feet to the Southeast corner of Lot 124, PENN PARK, a subdivision of record; thence N 872830W for 132.36 feet to the Southwest corner of Lot 124; thence N 23318E along the East right of way of Jarboe Street (50r/w) for 523.23 feet to the Point of Beginning. Containing 1.465 acres more or less.

 

is hereby approved, subject to the following conditions:

(for City Plan Commission). That a x ft. variance to the minimum required right-of-way width of 50 ft. for a minor (local residential) street so as to permit 40 ft. of right-of-way as shown on the development plan is hereby granted.

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer secure permits to repair sidewalks, curbs, and gutters as necessary along the development street frontage as required by the Department of Public Works in accordance with Chapters 56 and 64 of the Code, prior to recording of the plat.

 

3.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas.

 

4.                  That the developer receive the approval of the Board of Zoning Adjustment for any necessary variances.

 

5.                  That the developer receive the approval of the Board of Zoning Adjustment for a conditional use permit to allow for existing or proposed signage advertising the name and/or use of the property.

 

6.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Engineers Office prior to approval and issuance of any building permits, and that that the developer construct any improvements, as required by the City Engineers Office.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
