Approving a community unit
project plan on approximately 112.57 acres generally located at the northeast
corner of Martha Truman Road and Prospect Avenue. (13269-CUP-2)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
a community unit project plan on an approximately 112.57 acres generally
located at the northeast corner of Martha Truman Road and Prospect Avenue, and
more specifically described as follows:
A tract of land located in the Northwest Quarter of Section
10, Township 47, Range 33, Kansas City, Jackson County, Missouri, being more
particularly described as follows: beginning at the Northwest corner of said
Northwest Quarter; thence N 8852'47" E along the North line of said
Northwest Quarter a distance of 2638.52 feet to the Northeast corner of said
Northwest Quarter; thence S 0038'41" E along the East line of said
Northwest Quarter a distance of 1323.77 feet to a point on the South line of
the North half of said Northwest Quarter; Thence S 8857'17" W along said
south line a distance of 1319.37 feet to a point on the East line of the West
half of said Northwest Quarter; thence S 0038'22" E along said East line
a distance of 642.13 feet; thence S 8901'48" W parallel with the South
line of said Northwest Quarter a distance of 430.00 feet; thence S
0038'22" E parallel with the East line of the West half of said Northwest
Quarter a distance of 640.01 feet to a point on the North right-of-way line of
Martha Truman road as described in Book 3340 at page 385; thence S
8901'48" W along said North right-of-way line a distance of 889.47 feet
to a point on the West line of said Northwest Quarter; thence N 0038'02"
W along the West line of said Northwest Quarter a distance of 2600.73 feet to
the point of beginning. Contains 4,903,578 square feet or 112.570 acres more or
less. End of description.
is hereby approved, subject to
the following conditions:
That the developer cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
That the developer dedicate right-of-way as required by Development
Services, so as to provide a minimum of 50 feet of right-of-way as measured
from the centerline of Martha Truman Road.
That the developer make improvements required by the traffic study as
required by Development Services, so as to clear the trees on the west side of
Blue River Road, north of Martha Truman Road at the time of the platting of
Phase 1 to improve the line of site, as well as, the construction of a left
turn lane on Blue River Road at the time of the platting of Phase 2, if a
future traffic study requires the left turn lane.
That the developer design and construct all
public streets within the proposed development to local street standards as
required by Development Services, including construction of curb, gutter, and
sidewalks and installation of streetlights or as indicated by the traffic study
as required by Development Services.
That a variance to the standard construction of sidewalks be granted to
allow for sidewalks on both sides of only Road A and Road O.
That temporary off-site cul-de-sacs be constructed as required by
That the developer submit a macro storm drainage study to Development
Services for approval for the entire development when the plat is submitted and
that the developer construct any improvements as required by Development
That the developer submit plans for grading and siltation and erosion
control to Development Services for approval and permitting prior to the
commencement of any construction activities, so as to specifically construct
the southernmost storm water detention basin prior to the construction of Phase
That the developer install hard surface roads and provide for fire
protection as required by the Fire Department prior to construction beyond
That the developer extend water mains as required by the Water Services
That the developer obtain an approved certificate of survey prior to the
sale of individual town home, patio home, and condominium units.
That the developer apply for a land disturbance permit from Development
Services, prior to beginning any construction, grading, clearing, or grubbing
activities if the disturbed area exceeds one acre.
That the developer extend sanitary sewers as required by Development
That the developer obtain a floodplain certificate from Development
Services prior to beginning any construction activities within the floodplain.
That the developer show the limits of the 100-year floodplain on the
That the developer submit a final plan to the City Plan Commission for
approval including detailed information on building materials, elevations,
signage, grading, and landscaping for each phase of development.
That the developer submit a street tree planting plan as part of the
final plat and secure the approval of the City Forester for street trees
planted on right-of-way in front of residential lots, with a copy to be
submitted to the City Development Department staff. The plan shall include
size, species and placement of trees. The developer will plant and maintain
the trees in accordance with the plan.
That the developer submit a street name plan for the project for
approval by the Street Naming Committee prior to submittal of the first final
That the developer submit covenants, conditions and restrictions to the
Law Department for approval for the maintenance of private open space and enter
into a covenant agreement for the maintenance of any storm water detention area
A copy of said Community Unit
Project plan is on file in the office of the City Clerk with this ordinance and
is made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
Community Unit Project hereinabove, all public notices and hearings required by
the Zoning Ordinance have been given and had.
I hereby certify
that as required by Chapter 80, Code of Ordinances, the foregoing ordinance was
duly advertised and public hearings were held.
