ORDINANCE NO. 120724

Calling for submission to the voters of Kansas City, at an election to be held on November 6, 2012, a question amending the Charter of Kansas City to require that each person circulating an initiative, referendum or recall petition be a current resident of Kansas City, Missouri; directing the City Clerk to notify the responsible election authorities of the election on or after August 24, 2012, but not later than August 28, 2012; and recognizing this ordinance to be an emergency measure.

E IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. ELECTION CALLED. That an election is called on November 6, 2012, for the purpose of submitting to the voters of Kansas City an amendment to the City Charter.

Section 2. NOTICE TO ELECTION AUTHORITIES BY CITY CLERK. That following passage of this ordinance the City Clerk shall deliver certified copies of this ordinance and notice of election to the Clerk of Cass County, Board of Election Commissioners of Clay County, Board of Election Commissioners of Kansas City, and Board of Election Commissioners of Platte County, on or after August 24, 2012, but not later than August 28, 2012, which shall be the authority of each election authority of the City to submit the amendment to the electors of Kansas City and to give public notice as provided by law.

  Section 3. NOTICE OF ELECTION. The notice of election shall read as follows:

KANSAS CITY, MISSOURI

Notice is hereby given that the City of Kansas City has called a special election to be held on Tuesday, November 6, 2012, between the hours of 6:00 a.m. and 7:00 p.m., at which election all qualified voters residing within Kansas City, Missouri will be given the opportunity to vote.

 The official ballot will be in substantially the following form:

(City Residency for Petition Circulators)

 

Should the Charter of Kansas City be amended to require that each person circulating an initiative, referendum or recall petition be a current resident of Kansas City, Missouri?

Section 4. AMENDMENTS TO BECOME THE CHARTER OF THE CITY OF KANSAS CITY REASONS FOR RECALL. If a majority of the voters favor the question, then the amendment to the Charter of the City of Kansas City shall become effective December 1, 2012, which amendment shall read as follows:

  BE IT ADOPTED BY THE PEOPLE OF KANSAS CITY:

That the Charter of the City of Kansas City, Missouri is amended by repealing Section 730 and enacting new Section 730 of the Charter proposed by Ordinance _________ (as it may be amended) if it is adopted by the people, to read as follows:

Sec. 730. Signatures to petitions.

The signatures to an initiative, referendum, or recall petition need not all be appended to one paper, but to each separate petition paper there shall be attached an affidavit of the circulator thereof as provided by this section. Each circulator shall be a current resident of Kansas City, Missouri and each such petition paper filed by a circulator who is not a current resident of Kansas City, Missouri shall be invalid and the signatures thereon shall not be counted for purposes of determining the petition’s sufficiency. Each such petition paper shall consist of sheets of uniform size, printed and signed on only one side. Each such petition paper shall, at the top of such petition paper, contain a description of the ordinance or matter of such initiative, referendum, or recall petition which specifically identifies the subject of such initiative, referendum or recall petition. Each signer of any such petition paper shall sign his/her name in ink or indelible pencil, and shall indicate after his/her name his/her place of residence by street and number, or other description sufficient to identify the place. Each such petition paper shall provide a space for the date of each signature and each signer of such petition paper shall indicate the date he or she signs.

Every petition paper shall have printed on its face, “It is unlawful for anyone to sign any petition with any name other than his or her own, or knowingly to sign his or her name more than once for the same measure for the same election, or to sign a petition when he or she knows he or she is not a registered voter, or to encourage another to do so.”

The affidavit attached to the petition paper shall be substantially in the following form:

Section 5. EMERGENCY RECOGNIZED. This ordinance, providing for the submission of Charter amendments to the people of Kansas City, Missouri, is hereby recognized to be an emergency measure within the meaning of Section 503(a)(3)(A) of the Charter, and as such shall become effective immediately upon its passage.
