Approving a final plan in
District M-P on approximately a 12.96 acre tract of land within an existing M-P
district plan of 33.4 acres, generally located on the west side of N.E.
Chouteau Trafficway at N.E. 33rd Terrace. (13000-P-3)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
a final plan in District M-P (Planned Industrial District) on approximately a
12.96 acre tract of land generally located on the west side of N.E. Chouteau
Trafficway, on either side of N.E. 33rd Terrace, and more specifically
described as follows:
Final Plan area:
All of Lot 1 and Lot 2, Cerner Campus, Third Plat, A Subdivision of land in the
City of Kansas City, Clay County, Missouri
Within the Total
M-P District plan legally described as follows:
Tract 1: All of Lots
1, 2, 3, 4, 5, 6, 7 and 8, Chouteau Industrial Park Resurvey, a subdivision in Kansas City, Clay County, Missouri, according to the recorded plat thereof.
Tract 2: A part of
the West One Half of the Southeast One Quarter of Section 7, Township 50 North,
Range 32 West of the Fifth Principal Meridian, in Kansas City, Clay County,
Missouri, described as follows: Beginning at the southeast corner of Lot 4,
Chouteau Industrial Park, according to the duly recorded plat filed of record
May 26, 1961, in Plat Book 11 at page 16, which point is the west line of
Missouri State Highway No. 269 and is 312.53 feet north of the south line of
said Quarter Section; thence South 89 degrees 46 minutes 10 seconds West and
parallel to the south line of said Quarter Section a distance of 238.88 feet to
a point 626.16 feet west of the east line of the West One-Half of said Quarter
Section; thence South 0 degrees 19 minutes 40 seconds West and parallel to the
east line of the West One-Half of said Quarter Section a distance of 103.70
feet to a point in the north line of a tract condemned for park purposes in
Suit No. 23420 in Circuit Court of Clay County, Missouri; thence North 89
degrees 46 minutes 10 seconds East along said park tract to a point in the west
line of Missouri State Highway No. 269; thence northerly in the west line of
said Highway No. 269 to the point of beginning.
is hereby approved, subject to
the following conditions:
1.
That the developer update the previously approved macro storm drainage
study for the overall development to address the development amendments along
with a detailed micro study for approval prior to issuance of building permits
and make necessary improvements as required by Development Services.
2. That
the developer obtain the grading consents, and all grading, temporary
construction and drainage easements from the abutting property owner prior to
submitting any public improvements.
3.
That the developer obtain a permit from the Missouri Department of
Transportation prior to working within any State highway right-of-way,

That the developer submit plans for grading, siltation, and erosion
control to Development Services for approval and permitting prior to beginning
any construction activities.
5.
That the developer secure a site disturbance permit from Development
Services prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area exceeds one acre.
6.
That the developer extend sanitary sewers to ensure individual service
is provided to all proposed lots and determine adequacy as required by
Development Services.
7.
That the developer provide a storm water conveyance system to serve all
proposed lots within the development and determine adequacy as required by
Development Services.
8.
That the developer submit covenants, conditions and restrictions to the
Law Department for approval for the maintenance of private open space and enter
into a covenant agreement for the maintenance of any stormwater detention area
tracts.
9.
That the developer provide easements and extend water mains as required
by the Water Services Department.
10.
That the developer provide fire protection as required by the Fire Department.
11. That
the developer receive approval from the Board of Zoning Adjustment for a
setback variance and any other necessary variances prior to receiving a
building permit for Phase Two (2).
12. That
the developer abide by further corrections and/or recommendations of the City
Engineering Division of Public Works.
A copy of said final plan is on
file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
final plan hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
