ORDINANCE NO. 980310
Approving an amendment to a previously approved
development plan in District PD/C-2 (Planned District/Local Retail Business) on
approximately a 2.4 acre tract of land generally located at the northwest
corner of Ward Parkway and 85th Street. (7466-PD-10)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an amendment to a
previously approved development plan in District PD/C-2 (Planned District/Local
Retail Business) on approximately a 2.4 acre tract of land generally located at
the northwest corner of Ward Parkway and 85th Street, and more specifically
described as follows:
All that part of Lots
S-18 and that part of Lot T-19, Cresthill Acres, a subdivision in the City of
Leawood, Johnson County, Kansas, according to the recorded plat thereof,
together with that part of Lots 18, 19, 20, 47, 48 and 49, Cresthill Acres, a
subdivision in Kansas City, Jackson County, Missouri, according to the recorded
plat thereof, including part of the vacated Wyoming Street, lying west of and
adjacent to the west line of said Lots 47, 48 and 49, the above described
parcel of land lying partly in the State of Kansas and partly in the State of
Missouri, being more particularly described as follows: Beginning at the
southeast corner of Lot 49 of said Cresthill Acres, being also the point of
intersection of the north right of way line of 85th Street, with the west right
of way line of Ward Parkway, as said street and parkway are now both
established; thence North 8650'11" West along the south line of said Lot
49 and its westerly prolongation and along said north right of way line, a
distance of 168.49 feet; thence North 529'06" West, a distance of 41.46
feet; thence North 907'21" West, 44.65 feet; thence North 240'39"
East, 133.03 feet; thence North 8650'43" West, 134.29 feet to a point on
the west line of Lot T-19 of said Cresthill Acres; thence North 221'03"
West along the west line of Lots T-19 and S-18 of said Cresthill Acres and
along the east right of way line of State Line Road, as now established, a
distance of 106.44 feet; thence South 8729'34" East, a distance of 326.79
feet, to a point on the east line of Lot 47 of said Cresthill Acres; thence
South 237'17" West along the east line of Lots 47, 48 and 49 of said Cresthill
Acres and along the west right of way line of said Ward Parkway, a distance of
327.34 feet to the point of beginning. Containing 1.698 acres, more or less.
Also, all of Tract A,
James E. Grier Addition, a subdivision in Kansas City, Jackson County,
Missouri.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer dedicate additional right of way for 85th Street as required by
the Department of Public Works so as to provide a total of 50 feet of right of
way as measured from the centerline of 85th Street.
3. That
the developer construct sidewalks along 85th Street as required by the
Department of Public Works.
4. That
the developer construct sidewalks along Ward Parkway as required by the
Department of Public Works.
5. That
the developer enter into an agreement with the City as required by the
Department of Public Works whereby the developer agrees to contribute
$17,500.00 towards the cost of the signalization at 85th Street and State Line
Road.
A copy of said amendment is on file in the
office of the City Clerk under Document No. 980310, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
