ORDINANCE NO. 050302

 

Approving a Community Unit Project on an approximately 82 acre tract of land generally located approximately 1,200 east of N. Indiana Avenue, between N.E. 85th Terrace on the south and N.E. 92nd Street on the north. (13281-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 82 acre tract of land generally located approximately 1,200 east of N. Indiana Avenue, between N.E. 85th Terrace on the south and N.E. 92nd Street on the north, and more specifically described as follows:

 

A tract of land in the Southeast Quarter of Section 6, Township 51, Range 32, Kansas City, Clay County, Missouri, being described as follows: Beginning at the Northeast corner of the Southeast Quarter of said Section 6; thence South 0o2232 West (Deed South 0o0933 West), along the East line of said Southeast Quarter, 2634.67 feet (Deed 2634.58 feet) to the Southeast Quarter of said Southeast Quarter; thence North 89o3720 West (Deed North 89o5003 West) along the South line of said Southeast Quarter, 1344.84 feet (Deed 1345.17 feet) to the Southwest corner of the East 33.00 feet of the West One-half of said Southeast Quarter; thence North 0o2427 East (Deed North 0o1704 East), along the West line of the East 33.00 feet of the West One-half of said Southeast Quarter, 2630.71 feet to the Northwest corner of the East 33.00 feet of said West One-half; thence South 89o4728 East (Deed South 89o4253 East), along the North line of said Southeast Quarter, 1343.37 feet to the Point of Beginning. Containing 81.23 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro "overall" storm drainage study for the entire development to the City Engineer's Office for approval at the time the first plat is submitted, with a micro "detailed" storm drainage study to be submitted for each phase at the time of final platting, and that the developer construct any necessary improvements as required by the City Engineer's Office.

 

3. That the developer dedicate additional right of way for a collector street as required by the Department of Public Works so as to provide a minimum of 30 feet of right of way as measured from the centerline of N.E. 92nd Street.

 

4. That the developer improve the southern one-half of N.E. 92nd Street to collector street standards as required by the Department of Public Works, including curbs, gutters, storm sewers, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

5. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

6. That the developer make improvements required by the traffic study as required by the Department of Public Works.

 

7. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

8. That the developer subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works, and that the developer shall be responsible for all costs associated with subordination activities.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer extend sanitary sewer mains as required by the Department of Public Works.

 

11. That the developer construct temporary off-site cul-de-sacs as required by the Department of Public Works.

 

12. That the developer submit a street name signage plan for the entire development area for approval by the Street Naming Committee prior to submittal of the first final plat.

 

13. That any relocated streetlights be integrated into existing street light system as required by the City Engineers Office.

 

14. That the developer submit plans for grading, siltation, and erosion control to the City Engineer's Office for approval and permitting prior to beginning any construction activities.

 

15. That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

16. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the Department of Public Works.

 

17. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and for fencing material and heights of fencing along N.E. 92nd Street, as approved by the City Development Department staff, and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

18. That the developer submit a street tree planting plan with the final plat to the City Forester for approval with spacing, species and size of street trees to be approved by the City Forester.

 

19. That the developer submit a final community unit project plan for Tracts 3 and 4, including landscaping consisting of berms, trees, and plantings around and within the parking lots. The final plan shall also show proposed pedestrian circulation and elevation drawings of signage.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
