ORDINANCE NO. 060661
Approving the plat of Pershing
Road Addition, an addition in Kansas City, Jackson County, Missouri; accepting
and releasing various easements; authorizing the Director of Public Works to
accept partial deeds of release; and authorizing the City Clerk to file this
ordinance and attached documents.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the plat of Pershing Road Addition, a
subdivision in Kansas City, Jackson County, Missouri, a true and correct copy
of which is attached hereto and incorporated herein by reference is hereby
approved.
Section 2. That the plat granting and reserving unto
Kansas City an easement and license or right to locate, construct, operate and
maintain facilities including, but not limited to, water, gas, sewerage,
telephone, cable TV, surface drainage, underground conduits, pad mounted
transformers, service pedestals, any and all of them upon, over, under and
along the strips of land outlined and designated on the plat by the words
utility easement or U/E be and the same are hereby accepted and where other
easements are outlined and designated on the plat for a particular purpose, be
and the same are hereby accepted for the purpose as therein set out.
Section 3. That all right, title and interest in the
following recorded easements be and the same are hereby released to the
respective owners, their successors or assigns, over that part of aforesaid
easement under the following:
1.
Utility easement in the vacated alleys within former Tract B-2 herein
described, reserved in Ordinance No. 17815, vacating the same, a copy of which
was recorded July 7, 1954 in Book B-4870, at Page 380, as Document No.
B-127983.
2.
Utility easement in the vacated alleys within Tract B-1 herein described,
reserved in Ordinance No. 19327, vacating the same, a copy of which was
recorded August 17, 1955 in Book B-4990, at Page 123, as Document No. B-171204.
3.
Easements, if any, for public utilities installed in, under or upon the vacated
alleys prior to the vacation thereof, and for which no notice appears in the
Office of the Recorder of Deeds.

Utility easements in the vacated streets and alleys, as reserved in the
following ordinances vacating these streets and alleys: Ordinance No. 40954, a
copy of which was recorded January 20, 1922 in Book B-2236, at Page 304, as
Document No. A-46267; Ordinance No. 40955, a copy of which was recorded January
20, 1922 in Book B-2258, at Page 180, as Document No. A-46270; Ordinance No.
40956, a copy of which was recorded January 20, 1922 in Book B-2197, at Page
455, as Document No. A-46269; Ordinance No. 52334, a copy of which was recorded
December 30, 1926 in Book B-2735, at Page 502, as Document No. A-324000;
Ordinance No. 52332, a copy of which was recorded December 30, 1926 in Book
B-2738, at Page 510, as Document No. A-324001; Ordinance No. 40953, a copy of
which was recorded in Book B-2258, at Page 177, as Document No. A-46265;
Ordinance No. 52333, a copy of which was recorded in Book B-2735, at Page 504,
as Document No. A-324002; and Ordinance No. 759, a copy of which was recorded
July 15, 1929 in Book B-2917, at Page 20, as Document No. A-419149.

Utility Easement in the vacated alley herein described, reserved in Ordinance
No. 17815 vacating the same, a copy of which was recorded in Book B-4870, at
Page 380, as Document No. B-127983.
6. Easements, if any, for public utilities installed in,
under or upon the Waldo Avenue and in the vacated North/South alley lying East
of Lots 41 and 42, Waldo Tract, prior to the vacation thereof, and in that part
of the alley located in Lot 5, WALDO TRACT, which has been vacated, and for
which no notice appears in the Office of the Recorder of Deeds.
Section 4. That the grades of the streets and other
public ways set out on the plat, herein accepted, are hereby established at the
top of curb, locating and defining the grade points which shall be connected by
true planes or vertical curves between such adjacent grade points, the
elevations of which are therein given, in feet above the City Directrix.
Section 5. That the Director of Public Works is
hereby authorized to accept two (2) Partial Deeds of Release Agreements, to be
in a form substantially as that attached hereto as Exhibit A and B and
incorporated herein by reference.
Section 6. That the City Clerk is hereby directed to
file copies of this ordinance, together with the two Partial Deeds of Release
Agreements, in the Office of the Recorder of Deeds of Jackson County, Missouri
together with all other relevant documents.
Section 7. That the Council finds that the City
Plan Commission has duly endorsed its approval of this Ordinance hereon.
