RESOLUTION NO. 081268

Approving an amendment to the Briarcliff-Antioch-Davidson Area Plan, by modifying the Land Use Plan and Map within that area that is generally located on the west side of U.S. Highway 169, about 2,000 feet south of N.W. Englewood Road, to recommend changes from low density residential uses to medium-high density residential uses. (241-S-7)

WHEREAS, by Committee Substitute for Resolution No. 49550, adopted September 28, 1978, the City adopted the Briarcliff-Antioch-Davidson Area Plan as a guide for development and redevelopment of that area generally bounded by Englewood Road on the north, Chouteau Trafficway on the east, North Kansas City city limit line on the south and the Kansas City city limit line on the west; and

WHEREAS, said Briarcliff-Antioch-Davidson Area Plan was first amended on November 25, 2003, by Resolution No. 031094; and

WHEREAS, said Briarcliff-Antioch-Davidson Area Plan was next amended on July 20, 2006, by Resolution No. 060728; and

WHEREAS, said Briarcliff-Antioch-Davidson Area Plan was next amended on September 21, 2006 by Resolution No. 060958; and

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Briarcliff-Antioch-Davidson Area Plan as it affects that area generally located on the west side of U.S. Highway 169, about 2,000 feet south of N.W. Englewood Road, from low density residential uses to medium-high density residential uses; and

WHEREAS, public notice of a hearing before the City Plan Commission was published on _______________________; and

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on _________________________; and

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on _______________, 2008, recommend approval of the proposed amendment to the Briarcliff-Antioch-Davidson Area Plan; NOW, THEREFORE,

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

Section A. That an amendment to the Briarcliff-Antioch-Davidson Area Plan is hereby approved as to the Proposed Land Use Plan and Map for that area generally located on the west side of U.S. Highway 169, about 2,000 feet south of N.W. Englewood Road, to recommend changes from low density residential uses to medium-high density residential uses. A copy of the amended Land Use Plan and Map for the Briarcliff-Antioch-Davidson Area Plan is attached hereto as Exhibit A and made a part hereof.

Section B. That the amendment to the Briarcliff-Antioch-Davidson Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
