Approving the preliminary plat of
Weaver Manor Condominium on a .17 acre tract of land generally located on the
east side of Walnut Street, south of the 41st Street intersection (4107 Walnut Street). (SD 1183)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Weaver Manor Condominium on a .17 acre tract of land
generally located on the east side of Walnut Street, south of the 41st Street intersection (4107 Walnut Street), and more specifically described as follows:
The South 55 feet of
the East 132 feet of the West 162 feet of Lot 64, and the North 10 inches of
the South 55 feet 10 inches of the East 20 feet of the West 162 feet of Lot 64,
GRAND AVENUE HIGHLANDS, a subdivision in Kansas City, Jackson County,
Missouri. Also described as:
Beginning at the
intersection of the East right of way line of Walnut Street (60r/w) and the
South line of Lot 64, GRAND AVENUE HIGHLANDS, a subdivision in Kansas City,
Jackson County, Missouri, also being 30.00 feet from the Southwest corner of
Lot 64; thence N 23439E along said East line for 55.00 feet; thence S
873624E parallel to said South line for 112.00 feet; thence N 23439E for
0.83 feet; thence S 873624E for 20.00 feet; thence S 23439W for 55.83
feet to the South line of Lot 64; thence N 873624W for 140.00 feet to the
Point of Beginning.
is hereby approved, subject to
the following conditions:
1. That the developer shall cause the area to be platted and
processed in accordance with Chapter 66, Code of Ordinances of the City of
Kansas City, Missouri, commonly known as the Subdivision Regulations.
2. That the developer secure permits to repair sidewalks, curbs,
and gutters as necessary along all development street frontages as required by
Development Services in accordance with Chapters 56 and 64, Code of Ordinances,
prior to recording of the plat.
3. That the developer submit covenants, conditions and
restrictions to the Law Department for approval for the maintenance of common
areas and private open space tracts.
4.
That the developer receive approval of the Board of Zoning Adjustment
for any necessary variances.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
