ORDINANCE NO. 181010

 

Rezoning 3.6 acres generally located on the west side of Wornall Road between W. 84th Street to the north and W. 85th Street to the south from Districts B3-2 and R-6 to Districts B2-2, and approving a development plan which also serves as a preliminary plat, to allow for site improvements and redevelopment. (CD-CPC-2018-00199 & CD-CPC-2018-00207)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1183, rezoning an area of approximately 3.6 acres generally located on the west side of Wornall Road between W. 84th Street to the north and W. 85th Street to the south from Districts B3-2 (Community Business 3) and R-6 (Residential 6) to Districts B2-2 (Neighborhood Business 2), said section to read as follows:

 

Section 88-20A1183. That an area legally described as:

 

TRACT I: All that part of the Northeast Quarter of the Northeast Quarter of Section 19, Township 48, Range 33, in Kansas City, Jackson County, Missouri described as follows: Beginning at the intersection of the South line of 84th Street and the West line of Wornall Road, as said road and street appear on the plat of Summit Heights, a subdivision in Kansas City, Jackson County, Missouri; thence South along the West line of Wornall Road 415.35 feet; thence West 388 feet, more or less, to the Southernmost corner of Lot 38 in said Summit Heights; thence North along the East line of said Lot 38 and the prolongation there of 293.18 feet; thence East parallel to the South line of 84th Street 263 feet to the Southeast corner of Lot 46 in said Summit Heights; thence North along the East line of said Lot 46 to its intersection with the South line of 84th Street; thence East along the South line of 84th Street to beginning, except those parts thereof in 84th Street and in Wornall Road.

 

TRACT II: The East 5 feet of Lot 44; and all of Lots 45 and 46, Summit Heights, a subdivision in Kansas City, Jackson County, Missouri, except that part in 84th Street.

 

TRACT III: A nonexclusive permanent driveway easement for pedestrians or vehicle passage for the benefit of Tract II, over and across the following described property: The West 20 feet of the East 155 feet of the South 220 feet of the Northeast Quarter of the Northeast Quarter of Section 19, Township 48, Range 33, in Kansas City, Jackson County, Missouri, filed as Document No. K-808007 in Book K-1755 at Page 1798.

 

The East 5 feet of Lot 43, measured on the front and rear lines of said lot an all of Lot 44, except the East 5 feet thereof, measured on the front and rear lines of said lot, Summit Heights, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

The East 5 feet of Lot 42 and all of Lot 43, except the East 5 feet thereof as measured on the front and rear lines of said lot, Summit Heights, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

is hereby rezoned from Districts B3-2 (Community Business 3) and R-6 (Residential 6) to Districts B2-2 (Neighborhood Business 2), all as shown outlined on a map marked Section 88-20A1183, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  The project area shall be rezoned from B3-2 and R-6 to B2-2.

 

2.                  The developer shall screen dumpster enclosures in accordance with 88‑425‑08.

 

3.                  The developer shall provide long‑term bicycle parking as required of 88‑420‑09 for each use within the site.

 

4.                  The developer shall coordinate with the Parks Department to determine appropriate street trees for those areas under power lines.

 

5.                  The developer shall remove all existing pole signage on site.

 

6.                  All signage and sub‑tenant signage shall conform to 88‑445.

 

7.                  The landscaping strip along the west property line shall remain densely landscaped with the installation of new and/or existing to remain at all times.

 

8.                  The developer shall screen all rooftop and ground mounted utilities in accordance with 88‑425‑08.

 

9.                  The developer shall submit a storm drainage analysis, from a Missouri-licensed civil engineer, in accordance with the latest adopted version of APWA 5600 standards to ensure no increase in the 10% or 1% runoff peak rates or volumes, including a BMP level of service analysis per the latest adopted version of the MARC DMP Manual, prior to approval and
issuance of any building permits, and the developer shall secure permits to construct any improvements as required prior to issuance of any certificate of occupancy.

 

10.              The developer shall follow current KCMO service line standards (https://www.kcwaterservices.org/wp‑content/uploads/2018/07/2018‑Rules‑and‑Regulations‑for‑Water‑Service‑Lines.pdf)

 

11.              The developer shall have separate connections to the fire and domestic service lines to the public water main.

 

12.              The developer shall provide turning movement templates for the trucks going to and from the loading dock of the grocery/retail building.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
