COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 081178

Approving recommendations from two of the Arterial Street Impact Fee Advisory Committees; appropriating $1,075,000.00 in the Arterial Street Impact Fee Fund; authorizing the Director of Public Works to execute a cooperative agreement with Hunt Midwest Real Estate Development, Inc. for the design of street improvements; and designating requisitioning authority.

WHEREAS, Ordinance No. 070479 passed on April 26, 2007, allocated $30,000.00 for preliminary engineering for Platte Purchase Drive, Project No. 89008139, and $75,000.00 for the 96th Street Corridor project from Platte Purchase Drive to U.S. 169, Project No. 89008141; and

WHEREAS, on November 17, 2008, the Arterial Street Impact Fee District A Advisory Committee recommended reallocating $8,000.00 from the 96th Street Corridor project, to the Platte Purchase Drive project; and

WHEREAS, on March 21, 2007, the Arterial Street Impact Fee District C Advisory Committee recommended allocating $1,200,000.00 for the preparation of drawings, plans and specifications, and construction for N. Eastern Avenue from approximately 2,000 feet north of Highway 291 south to Shoal Creek Parkway; and

WHEREAS, $125,000.00 has previously been appropriated by Ordinance No. 050890 for the design of the portion of N. Eastern Avenue north of Highway 291; and

WHEREAS, the City and Hunt Midwest Real Estate Development, Inc. desire to enter into a cooperative agreement for the design of N. Eastern Avenue from N.E. Cookingham Drive south to Shoal Creek Parkway; NOW, THEREFORE,

  BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That the recommendation of the Arterial Street Impact Fee District A Advisory Committee for the project reallocations in Impact Fee District A is hereby approved.

Section 2. That the recommendation of the Arterial Street Impact Fee District C Advisory Committee for the project allocation in Impact Fee District C is hereby approved.

Section 3. That the sum of $1,075,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Arterial Street Impact Fee Fund to the following account in the Arterial Street Impact Fee Fund:

09-2430-897123-B N. Eastern Ave. $1,075,000.00

Section 4. That the Director of Public Works is hereby authorized to execute a cooperative agreement with Hunt Midwest Real Estate Development, Inc. for the design of street improvements to N. Eastern Avenue from N.E. Cookingham Drive south to Shoal Creek Parkway. The agreement is approved in substantial form as that on file in the office of the Director of Public Works, subject to the receipt of all required approvals, from funds appropriated in account number 09-2430-897123-B, in an amount not to exceed $375,000.00.

Section 5. That the Director of Public Works is designated requisitioning authority on Account No. 09-2430-897123.
