RESOLUTION NO. 050246

 

Amending the Downtown Industrial Area Plan for an area of approximately 42 acres generally bounded by 18th Street on the north, Cherry Street and the north-south alley east of Cherry Street on the east, 20th Street and the KC Terminal tracks on the south and the north-south alley west of Grand Boulevard on the west, to allow for an expansion in allowed uses by changing the recommended land use from light industry and mixed use to mixed use (residential, commercial and light industrial). WHEREAS, on June 15, 1978, the City Council by Resolution No. 49188 adopted the Downtown Industrial Area Plan being the Plan for development and redevelopment of that area bounded by I-35 on the north, the Terminal Railroad tracks on the south, Troost Avenue on the east and Southwest Trafficway on the west; and

 

WHEREAS, said Downtown Industrial Area Plan was amended on June 25, 1998, through the adoption of Resolution No. 980549; was amended on January 13, 2000, through the adoption of Resolution No. 991627; was amended on August 29, 2002, through the adoption of Resolution No. 020942; was amended on February 20, 2003, through the adoption of Resolution No. 030117; and was further amended on July 1, 2004, through the adoption of Resolution No. 040576; and

 

WHEREAS, after further review by the City Development Department, it has been deemed appropriate to further amend the Downtown Industrial Area Plan as it affects that area generally bounded by 18th Street on the north, Cherry Street and the north-south alley east of Cherry Street on the east, 20th Street and the KC Terminal tracks on the south and the north-south alley west of Grand Boulevard on the west, to allow for an expansion in allowed uses by changing the recommended land use from light industry and mixed use to mixed use (residential, commercial and light industrial); and

 

WHEREAS, public notice of a hearing was published for the City Plan Commission Hearing on November 1, 2004; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on November 16, 2004; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on November 16, 2004, make its recommendation on the proposed amendment to the Downtown Industrial Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 


Section A. That the Downtown Industrial Area Plan is hereby amended as to the Proposed Land Use Plan and Map for that area generally bounded by 18th Street on the north, Cherry Street and the north-south alley east of Cherry Street on the east, 20th Street and the KC Terminal tracks on the south and the north-south alley west of Grand Boulevard on the west, to allow for an expansion in allowed uses by changing the recommended land use from light industry and mixed use to mixed use (residential, commercial and light industrial). A copy of the amendment to the Proposed Land Use Plan and Map of the Downtown Industrial Area Plan is attached hereto as Exhibit A and incorporated herein by reference.

 

Section B. That the amendment to the Downtown Industrial Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997 by Committee Substitute 030117 for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the above that all public notices and hearings have been given and had.
