ORDINANCE NO. 180883

 

Estimating and appropriating $275,654.27 in the Capital Improvements Fund; authorizing the Director of Public Works to enter into a Congestion Mitigation and Air Quality Agreement with the Missouri Highway and Transportation Commission for the Vivion Road Streetscape Project; directing the City Clerk to file certain documents with the appropriate offices; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, Congestion Mitigation and Air Quality Agreement, Grant No. CMAQ-9901(437), provides grant funds to be used for project design and ROW acquisition related to complete street improvements along Vivion Road approximately from N. Highland Avenue and Chouteau Trafficway, NOW THERFORE

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the revenue in the following account of the Capital Improvements Fund is hereby estimated in the following amount:

 

19-3090-895111-476475-89008267 Vivion Road Streetscape $275,654.27

 

Section 2. That the sum of $275,654.27 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account:

 

19-3090-895111-B-89008267 Vivion Road Streetscape $275,654.27

 

Section 3. That the Director of Public Works is hereby authorized to enter into a Congestion Mitigation and Air Quality Agreement with the Missouri Highway and Transportation Commission to assist design and ROW acquisition related to complete street improvements along Vivion Road approximately from N. Highland Avenue and Chouteau Trafficway in accordance with the Vivion Road Streetscape Plan, Grant No. CMAQ-9901(437). A copy of the Program Agreement is on file in the office of the Director of Public Works.

 

Section 4. That the City Clerk is hereby directed to file a copy of the ordinance, together with the Program Agreement attached hereto, with the office of the Recorder of Deeds for Jackson County, Missouri, and with the Secretary of the State of Missouri.

 

Section 5. That the Director of Public Works is hereby designated as requisitioning authority for Account No. 19-3090-895111.

 

Section 6. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
