ORDINANCE NO. 100990

 

Authorizing a first amendment to the Lease Agreement with Swope Community Builders for Block 66 and a portion of Block 65 in connection with property insurance requirements.

 

WHEREAS, the City and Swope Community Builders (“SCB”) entered into a Lease Agreement for Block 66 and a portion of Block 65 (“Lease”) in the East Village area in downtown Kansas City; and

 

WHEREAS, the Lease requires that SCB obtain all risk or fire insurance including standard extended endorsement perils, leakage from fire protective devices and other water damage; and

 

WHEREAS, SCB has not been able to obtain such coverage and the City agrees to waive this requirement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to execute a First Amendment to the Lease Agreement with Swope Community Builders for Block 66 and a portion of Block 65, waiving the insurance requirement for leakage from fire protective devices and other water damage and adding certain provisions relating to repairs caused by such damage.
