ORDINANCE NO. 120777

 

Approving the plat of Parkway Village First Plat, an addition in Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways; authorizing the Director of Development to execute and/or accept certain agreements; and authorizing the City Clerk to record this ordinance and attached documents. (SD1094D)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Parkway Village First Plat, a subdivision in Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference, is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That various easements in Clay County, executed by the following entities, and which appear of record as the instrument numbers, and respective book and page numbers are hereby accepted for the purposes stated thereof:

A strip of land 10.00 feet in width, being the full release of a 10.00’ Pedestrian Access Easement established and shown on the subdivision plat of “Renaissance Place Second Plat” a subdivision of land recorded October 27, 2005, as Document No. 2005052589, in Plat Book G, at Page 21, said strip of land situated on Lot Q of said plat and located in the Northwest Quarter of Section 18, Township 51 North, Range 32 West of the 5th Principal Meridian in Kansas City, Clay County, Missouri, said 10.00 feet wide strip of land lying 5.00 feet on each side of the following described centerline:

 

Commencing at the Northwest corner of said Lot Q, thence South 03 degrees 20 minutes 42 seconds West along the Westerly line of said Lot Q, 81.08 feet to an angle point in said Westerly lot line and the centerline of said platted Pedestrian Access Easement and the Point of Beginning of the pedestrian access easement release centerline to be herein described: thence South 83 degrees 56 minutes 52 seconds East, along said platted easement centerline, 169.69 feet to a point on the Easterly line of said Lot Q and the Point of Termination of said pedestrian access easement release.

 

The outer limits of said strip of land shall be lengthened or shortened as necessary to terminated on the Westerly line of said Lot Q at the Point of Beginning and on the Easterly line of said Lot Q at the Point of Termination.

 

This pedestrian access easement is located over part of proposed Lots 41 and 42 of Block 1 of the proposed replat and subdivision of “Parkway Village First Plat”, a proposed subdivision in said Kansas City, Clay County, Missouri.

Commencing at the Northwest corner of said Lot “G”, thence Southerly along the Westerly line of said Lot “G” along a curve to the left, having an initial tangent bearing of South 16 degrees 37 minutes 54 seconds East, with a radius of 475.00 feet, a central angle of 10°45’42” and an arc distance of 89.22 feet to the centerline of said platted 10 feet wide sanitary sewer easement; thence North 00 degrees 00 minutes 00 seconds E, along said centerline, 57.67 feet to the Point of Beginning of the centerline of the 10.00 feet wide easement release to be herein described: thence continuing North 00 degrees 00 minutes 00 seconds East along said platted easement centerline, 13.95 feet to the Northerly end of said platted easement and the Point of Termination of said Easement Release.

 

This easement is located on Lot 53 of the proposed replat and subdivision of “Parkway Village First Plat”, a proposed subdivision in said Kansas City, Clay County, Missouri.

Containing 571 square feet or 0.01 acres, more or less.

The outer limits of said strip of land shall be lengthened or shortened as necessary to terminated on the Easterly lot line of said Lot P and said Lot Q at the Point of Beginning.

 

This easement is located over part of proposed Lots 42 and 43 of Block 1 of the proposed replat and subdivision of “Parkway Village First Plat”, a proposed subdivision in said Kansas City, Clay County, Missouri.

Commencing at the Southeast corner (most Easterly corner) of said Lot O, thence North 27 degrees 23 minutes 37 seconds West along the Northeasterly line of said Lot O, 81.00 feet to a point on the centerline of said 15.00 feet wide platted Storm Drainage Easement and the Point of Beginning of the Easement Release centerline to be herein described: thence South 62 degrees 36 minutes 23 seconds West along said platted easement centerline, 152.44 feet to a point on the Southwesterly line of said Lot O and on the Northeasterly line of said Tract R, (said point being North 29 degrees 36 minutes 17 seconds West, 81.06 from the Southwest corner of said Lot O and the Southeast corner of said Tract R as measured along said Lot and Tract line); thence South 06 degrees 52 minutes 03 seconds West along said platted easement centerline, 32.22 feet to a point on the Northerly line of a 15.00 feet wide Storm Drainage Easement recorded as Document No. 2011015345, in Book 6622 at Page 172 and the Point of Termination of said Easement Release centerline.

 

The outer limits of this release shall be lengthened or shortened as necessary to terminate on the Northeasterly lot line of said Lot O at the Point of Beginning and on the Northerly line of said Storm Drainage Easement recorded in Book 6622 at Page 172 at the Point of Termination.

 

This easement is located over part of proposed Lot 46 of Block 1 of the proposed replat and subdivision of “Parkway Village First Plat”, a proposed subdivision in said Kansas City, Clay County, Missouri.

 

Section 5. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

Section 6. That the Director of City Development is hereby authorized to execute and/or accept any and all agreements necessary to clear the title of any right of way, utility easements or other public property dedicated on the plat.

 

Section 7. That the City Clerk is hereby directed to record copies of this ordinance, together with the documents described herein and all other relevant documents, when the plat has been released for recording, in the Office of the Recorder of Deeds of Clay County, Missouri.

 

Section 8. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
