COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 100721

 

Declaring it necessary to change and reestablish the grades of, and the relocation, opening, establishing and dedicating of street right of way on N.W. 72nd Street, N. Green Hills Road, and N.W. Waukomis Drive, all in Kansas City, Platte County, Missouri; and directing the City Clerk to cause a notice to be published as provided for herein.

 

WHEREAS, Resolution No. 081155 approved the Line Creek Development Plan as a guideline for infrastructure and development in the Line Creek Valley; and

 

WHEREAS, part of that development plan recommended capital improvements and traffic planning that reduced the need for four lane arterials; and

 

WHEREAS, this project will extend N.W. 72nd Street and provide a roundabout to provide improved traffic flow and calm traffic on a street with history of severe accidents and fatalities; and

 

WHEREAS, the Council finds that for the public good it is necessary that the grades on N.W. 72nd Street, N. Green Hills Road, and N.W. Waukomis Drive be changed and reestablished; and

 

WHEREAS, the Council further finds that for the public good it is necessary to relocate, open, establish and dedicate street right of way on N.W. 72nd Street, N. Green Hills Road, and N.W. Waukomis Drive, all in Kansas City, Platte County, Missouri; and

 

WHEREAS, the Council further finds the Director of Public Works, as evidenced by his issuing a Declaration of Necessity, No. 5318 has caused the plans and specifications for Project Nos. 89008148, N.W. 72nd Street Extension, Street and Storm Improvements and 89008205, N.W. Waukomis Drive, Street and Storm Improvements to be prepared; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds and declares it necessary to change and reestablish the grades on N.W. 72nd Street which shall be constructed as a two-lane modified secondary arterial, from N. Polk Avenue to N.W. Waukomis Drive; N.W. Waukomis Drive which shall be constructed as a two-lane modified secondary arterial with a center turn lane or median, from N. Bryan Avenue to N.W. 72nd Street; and N. Green Hills Road which shall be constructed as a two-lane modified secondary arterial with a center turn lane or median, from N.W. 72nd Street to N.W. Platte Brooke Drive, all in Kansas City, Platte County, Missouri; with the following described centerlines, as follows, to wit:

 


N.W. 72nd Street

Commencing at the Southwest corner of the Southwest Quarter of Section 17, Township 51 North, Range 32 West of the 5th Principal Meridian in the City of Kansas City, Platte County, Missouri; thence S 1 deg. 39 min. 17 sec. W, a distance of 11.85 feet to the Point of Beginning with Stationing 10+00; thence S 88 deg. 52 min. 09 sec. E, a distance of 1409.28 feet; thence on a curve to the Left having a radius of 758.00 feet, a distance of 176.12 feet; thence N 77 deg. 49 min. 05 sec. E, a distance of 688.78 feet; thence on a curve to the Right having a radius of 700.00 feet, a distance of 181.10 feet; thence S 87 deg. 21 min. 31 sec. E, a distance of 618.41 feet; thence on a curve to the Right having a radius of 700.00 feet, a distance of 230.02 feet; thence on a curve to the Left having a radius of 700.00 feet, a distance of 255.17 feet; thence S 89 deg. 25 min. 01 sec. E, a distance of 127.18 feet to a Point of Inflection with Stationing 191+35.27 where the Stationing changes to 0+00.00; thence N 88 deg. 18 min. 51 sec. E, a distance of 67.32 feet; thence on a curve to the Right having a radius of 140.00 feet, a distance of 54.25 feet; thence S 69 deg. 29 min. 02 sec. E, a distance of 57.08 feet; thence on a curve to the Left having a radius of 319.93 feet, a distance of 18.52 feet; thence on a curve to the Left having a radius of 160.00 feet, a distance of 79.10 feet; thence on a curve to the Right having a radius of 280.00 feet, a distance of 71.37 feet; thence S 86 deg. 31 min. 15 sec. E, a distance of 84.24 feet to the Point of Terminus.

 

N. Green Hills Road and N.W. Waukomis Drive

Commencing at the Northwest corner of the Southeast Quarter of Section 17, Township 51 North, Range 32 West of the 5th Principal Meridian in the City of Kansas City, Platte County, Missouri; thence S 8 deg. 40 min. 31 sec. E, a distance of 606.09 feet to the Point of Beginning with Stationing 168+80; thence S 09 deg. 55 min. 50 sec. E, a distance of 188.10 feet; thence on a curve to the Right having a radius of 723.00 feet, a distance of 119.22 feet; thence S 00 deg. 28 min. 58 sec. E, a distance of 137.45 feet; thence on a curve to the Left having a radius of 736.00 feet, a distance of 175.24 feet; thence on a curve to the Left having a radius of 1050.01 feet, a distance of 625.63 feet; thence S 48 deg. 15 min. 48 sec. E, a distance of 385.81 feet; thence on a curve to the Right having a radius of 700.00 feet, a distance of 426.29 feet; thence S 13 deg. 22 min. 17 sec. E, a distance of 197.54 feet to a Point of Inflection with Stationing 191+35.27, said point being the point where the described centerline above shall be called North Green Hills Road and where the described centerline below shall be called NW Waukomis Drive; thence S 13 deg. 22 min. 17 sec. E, a distance of 534.62 feet; thence on a curve to the Left having a radius of 700.00 feet, a distance of 318.30 feet; thence S 39 deg. 25 min. 30 sec. E, a distance of 177.16 feet; thence on a curve to the Right having a radius of 3000.00 feet, a distance of 312.41 feet; thence S 33 deg. 27 min. 30 sec. E, a distance of 190.29 feet; thence on a curve to the Left having a radius of 1350.00 feet, a distance of 240.33 feet; thence S 43 deg. 39 min. 30 sec. E, a distance of 35.80 feet; thence on a curve to the Left having a radius of 5006.00 feet, a distance of 715.48 feet to the Point of Terminus.

 

Section 2. That the Council hereby directs that the City Clerk cause a notice of said grade changes to be published in the newspaper doing the city printing, on each day of issue of said newspaper for a period of ten (10) days, starting on or about the date following the passage of this ordinance, and providing a period of thirty (30) days for remonstrance starting the same day as the first day of the publication.

 

Section 3. That grades shall be of the nature described and specified in, and shall be done in accordance with the plans and specifications prepared and certified by the City Engineer under the supervision of the Director of Public Works and identified as KCMO Project Numbers 89008148, N.W. 72nd Street Extension, Street and Storm Improvements and 89008205, N.W. Waukomis Drive, Street and Storm Improvements, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

 

Section 4. That the width of the right of way of N.W. 72nd Street, N. Green Hills Road, and N.W. Waukomis Drive, as shown on the plans described in Section 3 of this ordinance, are hereby relocated, opened, established and dedicated as shown on said plans.

 

 Section 5. That changing and reestablishing grades on N.W. 72nd Street, N. Green Hills Road, and N.W. Waukomis Drive, is hereby authorized to commence when this ordinance becomes effective, and shall be built in accordance with the plans and specifications as described in Section 3 of this ordinance; locating and defining the grade points of said streets on the proposed project baseline stationing as found on said plans, said grade points being connected by straight grades (tangents) or vertical curves between such grade points, the elevations of which are herein given below in feet (NAVD88 directrix), along with other pertinent alignments data, to-wit:
